Thank you for your email of 13 May 2024, requesting copies of all responses
submitted to the tender for an Enterprise PAM Toolset. I have considered your
request under the Official Information Act 1982 (the Act). Please find my
decision on your request set out below.
Your request for copies of the responses is refused under section 9(2)(j) of the
Act to enable the Ministry to carry on, without prejudice or disadvantage,
negotiations (including commercial and industrial negotiations). The greater
public interest is in ensuring that government agencies can continue to
negotiate without prejudice.
I note the comments in your request that you
‘would like to ensure that the
public is getting value for money and the panel has acted without having made
a decision prior to the RFP being placed on the GETS website.’
As outlined in the Request for Proposal (RFP) documents, the Ministry is
committed to selecting a solution that best meets the needs of the Ministry as
well as meeting its obligations to the Five Principles of Government
Procurement and Government Procurement Rules (GPR) when planning,
sourcing, and managing our procurement. The Ministry has not yet made a
decision on this tender.
An independent probity auditor has been appointed by the Ministry to overview
the RFP processes and verify that the procedures set out in the RFP are
complied with and that probity principles are adhered to.
The role of the probity auditor is to report to the Ministry and its stakeholders
about compliance with the Government’s Principles and Rules of Sourcing and
best practice about probity, and its subsequent evaluation process.

The probity auditor is not an employee of the Ministry and is an observer on
the Evaluation Panel.
