I refer to your Official Information Act 1982 (OIA) request received on 28 May 2024, in
which you requested:
Can I be provided the updated content of each chapter, or each part of each
chapter for "Impaired driving"
I note that the previously published impaired driving instructions is detailed as
phase 1, can I please be provided phase 2
Additionally can it be noted if there are additional phases for this document
planned for the near future?
The Land Transport (Drug Driving) Amendment Act 2022 updated the Land Transport Act
1998 to establish a roadside oral fluid testing regime to test drivers for recent drug use.
To give effect to the legislation, Police took a phased approach, with Phase 1 beginning
with the updating of processes and policies concerning the infringement and criminal
offences that were created. Phase 2 was the introduction of the physical roadside oral
fluid testing regime for drug driving. Because Police was unable to procure a suitable oral
fluid testing device, Phase 2 has not been progressed at this stage and Police awaits
further amendments to legislation.
The
Impaired driving instruction replaced the
Alcohol and drug impaired driving
instruction. I have attached the last version of the
Alcohol and drug impaired driving
instruction and the current version of the
Impaired driving instruction.
Police regularly reviews all instructions to ensure they reflect operational needs and
legislative requirements.
