Official Information Act 1982 request: Government entities no longer in existence
Thank you for your request to the Ministry of Justice (the Ministry) of 30 June 2024 under the
Of icial Information Act 1982 (the Act). Specifically, you requested:
Please provide information as to how to obtain information under the Official
Information Act for entities no longer in existence. Specifically information that would
have been held by the Public Health Units prior to the July 2022 restructure of the
health system.
What section/sub section of the Official Information Act if any covers this
circumstance?
How would the Public Records Act apply in this circumstance? What agency/entity
would be responsible if any for holding the records of agencies/entities no longer in
existence?
Please provide examples from any sectors/agencies/entities where requests under
the Official Information Act have been successful in obtaining information from
agencies/entities that no longer exist.
This request is refused under section 18(e) of the Act, as this information is not held by the
Ministry. However, I am able to provide the following information, which I trust is of assistance
to you.
The Office of the Ombudsman may have some relevant guidance to assist with interpreting

Health NZ may be able to provide some guidance about how to request information that was
held by former Public Health Units, and can be contacted by emailing [email address]
The Public Records Act 2005 (the PRA) is administered by the Department of Internal af airs
(DIA). DIA may have some relevant guidance on how the PRA interacts with the Act, and can
be contacted by emailing [email address]
