Thank you for your email of 18 July 2024 to Te Kaunihera o Pōneke / Wellington City Council
(the Council). Referencing a Spinoff article from 17 May 2024, you are requesting that the
Council provides you with the following information:
1. Define what a deprecated law is
2. List all the laws WCC sees as deprecated
Your request has been considered under the Local Government Of icial Information and
Meetings Act 1987 (the Act). We have addressed your questions below.
1. This part is not a request for official information otherwise held by council. The word
‘deprecated’ is defined in English language dictionaries.
2. The Council does not have a list of laws that it views as being deprecated. This would
be a central government matter. Accordingly, your request for this list is refused under
section 17(g) of the Act, being that the information requested is not held by the local
authority.
If you are interested in the repeal of statutes that are considered no longer relevant in New
Zealand, this process is undertaken through a Statues Repeal Act. This process is managed
by central government agencies, not by local authorities. More information about this
process is contained in the following link:
Statutes repeal | The Treasury New Zealand. You
also may wish to consult t
he Ministry for Regulation a
t Ministry for Regulation.
You have the right, by way of complaint under section 28(1) of the LGOIMA, to request an
investigation and review of the Council’s response to your information request by the
Ombudsman. Information about how to make a complaint is available at
www.ombudsman.parliament.nz or freephone 0800 802 602.
