Resource Consent
Pursuant to the Resource Management Act 1991, the Bay of Plenty Regional Council, by a
decision dated 11 February 2010, hereby grants:
A resource consent:

under sections 15(1)(a), 15(1)(b) and 15(1)(d) of the Resource Management Act 1991 and Rule 37 of the
Bay of Plenty Regional Water and Land Plan to Discharge Stormwater to Tributaries of the Haumi Stream
subject to the following conditions:
1
Purpose
1.0
For the purpose of discharging stormwater to tributaries of the Haumi Stream and onto or into land
from the permit holder's 24.2 hectare Rainbow Mountain Timber Processing site.
2
Discharge Quantity
2.0
The maximum cumulative daily volume of stormwater discharged from the site shall not exceed
85,155 cubic metres corresponding to a one in 50 year return period and 24 hours storm event.
3
Point Of Discharge
3.0
The discharge points shall be as shown on B.O.P.R.C. Plan No. RC 65172-1 submitted with the
application.

Stormwater Management Plan
6.0
Within three months of granting of this consent the consent holder shall forward an updated
stormwater management plan to the chief executive of the Regional Council for approval. The
updated stormwater management plan shall be consistent with the requirements of this resource

consent. The management plan shall include but not be limited to the following:
•
Resource consent requirements;
•
Site management and responsibilities (whether operating or not);
•
Site operations (whether operating or not);
•
Operation and maintenance of the stormwater system;
•
Monitoring and reporting;
•
Contingency planning and procedures;
•
Erosion, sediment control and stormwater management;
•
As-built drawings of different outlets; and
•
Any other matters relevant to the management of stormwater at the site.
The Stormwater Management Plan can be included in the Environmental Management Plan for the
site.
7
Stormwater Sediment Control
7.1
Not less than three months before any activity can resume on site, the permit holder shall modify
Outlet #2 (Housing/dispatch yard), adjacent to State Highway 38 to improve its sediment retention
capacity and capability. The modification shall be in accordance with B.O.P.R.C. Plan No. RC
65172-2 and RC 65172-3, supplied by Gwilym Environmental Services and titled "Stormwater
Debris Trap", 15 May 2008.
7.2
The consent holder shall ensure that the stormwater system, including all drainage systems, pipe
systems, soakage pits, and stormwater pond are operated and maintained in accordance with the
latest version of the stormwater management plan.
7.3
The consent holder shall maintain adequate fencing around the ponds to keep the area free of
stock. In addition, the consent holder shall establish vegetation within the fenced area conducive to
the enhancement of the area’s ecological and aesthetic values to the satisfaction of the Chief
Executive of the Regional Council or delegate.
8
Notification of Work
8.1
Not less than five working days prior to the start of the works under condition 7.1, the consent
holder shall request (in writing) a site meeting between the site manager and the chief executive of
the Regional Council or delegate. Notification at this time shall include details of who is responsible
for on site management and compliance with consent conditions.
8.2
The consent holder shall notify (in writing) the Regional Council within 48 hours of the completion of
the construction works undertaken under condition 7.1.
9
Maintenance
9.1
The consent holder shall ensure that the stormwater system authorised under this consent,
including the rock filled drains, sumps, soakage trenches, and stormwater pond including any
associated erosion control works, are maintained in an effective capacity at all times.
9.2
The consent holder shall remove accumulated sediment from stormwater sediment traps and
retention systems when the sediment reaches 25% of their full capacity.
9.3
Sediment cleared from the stormwater sediment traps and retention systems shall be disposed of at
an authorised landfill if required (see advice note 4).
9.4
The consent holder shall ensure that the stormwater structures authorised under this consent are
stabilised and operated so as to avoid erosion as a result of the discharge.
9.5
The consent holder shall avoid or remedy any erosion that may occur as a result of the exercise of

this consent, if so directed by the chief executive of the Regional Council or delegate.
9.6
The consent holder shall set up level markers and/or transects so that sediment build up on the
base of the stormwater ponds can be monitored. The system of marking the levels of the sediment
build up shall be capable of being accurate to plus or minus 100 mm across the base of the ponds.
10
Stormwater Monitoring
10.1
While there is no activity on site, the consent holder shall take a stormwater sample from the dam
outlet of the Western Stormwater Retention System every three months from the commencement of
this permit and thereafter.
10.2
The consent holder shall have the stormwater samples taken under condition 10.1 analysed for the
following parameters:
(a) Suspended solids;
(b) Total arsenic;
(c) Total chromium;
(d) Total copper;
(e) Boron;
(f) Total petroleum hydrocarbons (TPH); and
(g) pH.
10.3
While there is no activity on site, the consent holder shall take a stormwater sample from the 'Pond
2' outlet of the Eastern Stormwater Retention System every three months from the commencement
of this permit.
10.4
While there is no activity on site, the consent holder shall take a stormwater sample from each of
the four stormwater discharge points to the north (State Highway 38) of the site, every three
months.
10.5
The consent holder shall have the stormwater samples taken under condition 10.3 and 10.4
analysed for the following parameters:
(a) Suspended solids;
(b) Total petroleum hydrocarbons (TPH);
(c) pH; and
(d) Total copper.
10.6
Within three months of any operations resuming at the site, the consent holder shall take a
stormwater sample from the dam outlet of the Western Stormwater Retention System, four times
per year, at no less than two months apart, after a period of rain in excess of 12 hours. The sample
shall be analysed for the parameters listed under condition 10.2.
10.7
Within three months of any operations resuming at the site, the consent holder shall take a
stormwater sample from the 'Pond 2' outlet of the Eastern Stormwater Retention System, four times
per year, at no less than two months apart, after a period of rain in excess of 12 hours. The sample
shall be analysed for the parameters listed under condition 10.5.
10.8
Within three months of any operations resuming at the site, the consent holder shall take a
stormwater sample from each of the four stormwater discharge points to the north (State Highway

38) of the site, four times per year, at no less than two months apart, after a period of rain in excess
of 12 hours. The samples shall be analysed for the parameters listed under condition 10.5.
10.9
The water sampling, sample preservation and water analysis shall be carried out as set out in the
latest edition of 'Standard Methods for the Examination of Water and Wastewater'
APHA/AWWA/WEF or using such other method as may be approved by the chief executive of the
Regional Council or delegate in writing.
10.10
Within two months of samples being taken, the consent holder shall forward the results of
stormwater quality monitoring to the Regional Council.
11
Stormwater Quality
11.1
Stormwater discharge shall be substantially free of floatable solids, oil and grease.
11.2
The consent holder shall take all practicable measures to ensure that on site discharges from
machinery degreasing and washdown water, petroleum and diesel storage and dispensing facilities
are prevented from entering stormwater.
11.3
The stormwater discharge from the Western Stormwater Retention System shall comply with the
following:
(a) The concentration of suspended solids shall not exceed 150 grams per cubic metre;
(b) The concentration of total arsenic shall not exceed 0.5 grams per cubic metre;
(c) The concentration of total chromium shall not exceed 1.0 grams per cubic metre;
(d) The concentration of total copper shall not exceed 1.0 grams per cubic metre;
(e) The concentration of total boron shall not exceed 5.0 grams per cubic metre;
(f) The concentration of total petroleum hydrocarbon (TPH) shall not exceed 1 gram per cubic
metre; and
(g) The pH shall not be less than 6.5 and not greater than 9 pH units.
11.4
The stormwater discharge from the Eastern Stormwater Retention System shall comply with the
following:
(a) The concentration of suspended solids shall not exceed 100 grams per cubic metre;
(b) The concentration of total petroleum hydrocarbons (TPH) shall not exceed 1 gram per cubic
metre; and
(c) The pH shall not be less than 6.5 and not greater than 9 pH units.
12
Chemicals On Site
12.1
The consent holder shall maintain a list of hazardous chemicals used on site to be made available
to Regional Council staff on request.
12.2
Only timber treatment chemicals approved by the Chief Executive of the Regional Council can be
used and stored on site. (Advice Note 5)
12.3
The consent holder shall obtain approval from the Chief Executive of the Regional Council, prior to
change timber treatment chemicals used on site.

13.0
All facilities associated with the use of timber treatment chemicals on this site shall comply with the
recommendations contained in the latest version of the "Best Practice Guideline for the Safe Use of
Timber Preservatives and Antisapstains Chemicals".
14
Environmental Management Plan
14.1
Within three months of any operations resuming at the site, the consent holder shall forward an
updated Environmental Management Plan to the chief executive of the Regional Council for
approval. The consent holder shall maintain and update as required the existing site Environmental
Management Plan. The Environmental Plan shall take into account all operations potentially
affecting the quality of the stormwater discharged and shall include but not be limited to the
following:
(a) Identification and quantity of all hazardous chemicals stored and in use on site;
(b) Contingency procedure for the prevention and removal of spills of hazardous chemicals;
(c) Provisions to prevent the discharge of oil; and
(d) Maintenance programme for the stormwater treatment system.
14.2
The site shall be operated, maintained and managed in accordance with the latest version of the
site Environmental Management Plan and Stormwater Management Plan.
14.3
The consent holder shall ensure that all relevant staff are familiar with the site Environmental
Management Plan.
15
Spill Contingency
15.1
The consent holder shall ensure that all equipment and material required to contain and clean up a
spill are maintained on site in accordance with the spill contingency plan held within the site
Environmental Management Plan.
15.2
The consent holder shall ensure that all relevant staff are familiar with the spill contingency plan
held within the site Environmental Management Plan.
16
Review
16.1
The Regional Council may, on the anniversary of the commencement of the consent and within six
months of receipt of any report submitted to the Regional Council under any condition of this
consent or any report required as a result of compliance monitoring by Council, serve notice on the
consent holder of its intention to review the conditions of this consent, under section 128 of the
Resource Management Act 1991. The purposes of this review may include:
(a) To modify any required monitoring/reporting and/or specify additional monitoring/reporting
and/or change the monitoring/reporting frequency required to address any identified adverse
effects;
(b) To assess, and if necessary to address, any identified adverse effects of any of the stormwater
discharges on the receiving stream;
(c) To assess and if necessary to review current discharge limits and control measures;
(d) To require the consent holder to adopt the best practicable option in accordance with section
128(1)(a)(ii) of the Resource Management Act 1991; and
(e) To ensure that management practices at the site are consistent with any provisions or
restrictions that are required to be implemented by the Regional Council for any National
Environmental Standards (NES).

Term Of Permit

This permit shall expire on 30 September 2029.

Resource Management Charges
18.0
The consent holder shall pay the Bay of Plenty Regional Council such administrative charges as
are fixed from time to time by the Regional Council in accordance with section 36 of the Resource
Management Act 1991.

The Resource Consent
19.0
The Resource Consent hereby authorised is granted under the Resource Management Act 1991
and does not constitute an authority under any other Act, Regulation or Bylaw.
Advice Notes
1
1.
Unless otherwise specified reporting and notification required for this consent shall be made in writing
to the Manager Pollution Prevention, Environment Bay of Plenty, Box 364, Whakatane or
[email address] including the consent number 65172.
2.
The consent holder is advised that non-compliance with consent conditions may result in
enforcement action against the consent holder and/or their contractor(s).
3.
This consent does not authorise the holder to discharge steam or timber drying kiln condensate.
4.
The stormwater sediments may require to be assessed against the Ministry for Environment Landfill
Waste Acceptance criteria before being disposed of.
5.
The applicant is required to apply to change condition 12.2 under section 127 of the Resource
Management Act before timber treatment activities using chemicals can resume at the site.
