OT would be a part of it – I estimate 2 hours. An hour to present and speak to the proposed
legislation and an hour for Pou Tangata technicians to ask questions and have a discussion
with OT about these changes. To give you an idea of what the questions will be like – here is
something I thought of over the weekend:
If a young person is detained by the police on the side of the road without the means
(like a cellphone) to contact or communicate with their parents or caregiver – will
Police facilitate and provide this contact?
If the gang legislation that is to be introduced means that all forms of
communication like cellphones, laptops, ipads etc are uplifted by the Police when
they enter a home occupied by a gang member and there are minors including young
men in the house who happened to be a whanau member of the gang member
detained by the police – will Police facilitate and provide contact for this young
person?
Discussion with OT will largely be based on the practicalities of implementing the
legislation and I know that technicians will want to understand the role and function of the
Police and the extent to which they will facilitate much needed support for young people.
Why? Because they will suffer harm which is another of Government’s priorities.
I would also want to know if OT are tracking and monitoring complaints lodged with the
Police with the implementation of the proposed legislation?

Given the seriousness of the proposals I would appreciate consideration of in person
attendance of OT at this hui. Pou Tangata technicians are all making time to convene
in person for this kaupapa and “showing up” to do face to face presentations will
demonstrate commitment to our relationship.

To help us prepare, I would like to cover a few things.
First, Iain Chapman will attend on behalf of Tusha Penny. As you may recall, both Tusha
and Phil are on leave next week. Iain is National Director Youth Justice Services and
Residential Care. Iain will be able to speak to the operational implications of the proposed
new law. Excellent – I would also like a copy of the
youth justice practice guidelines for
implementing the new changes so there is assurance of training and consistent adherence
to the implementation of the practice requirements.
Second, given your example questions below, I think it would be useful to have someone
from NZP attending. We could ask Supt Scott Gemmell who is based in Tāmaki Makaurau.
What do you think? Yes please having a person from the New Zealand Police would be helpful –
if Scott is able to make it that would be good. I would also like to know whether the direct
operational and working relationships that Iwi have in place with the New Zealand Police will
remain intact. Where there are no relationships established what is proposed by NZP to address
the need for cultural safety?
Third, I’d like to bring along, Nicole Beattie. She is a senior advisor at OT working on the
legislation providing for the “Young Serious Offender” and Military-Style Academy”. Nicole is also
based in Tāmaki Makaurau. Would that be ok? Kei te pai – implementation and practice of the
legislation as it is written is what will be honed in on. If Nicole is holding the pen on the drafting
of the legislation that is still being written she needs to come to the hui with an open mind.
Forth, Ministry of Justice wants to check what matters you would like to discuss so they can
prepare and bring along the right contacts. Would you like to discuss that further. I will advance
a request through Marcus Akuhata-Brown for our Chair Rahui Papa to meet with Andrew
Kibblewhite as soon as possible. Rahui’s interest is to understand the legislative reform
programme and to seek advanced notice of what Government is progressing as we are
concerned that we are being advised of matters too late which goes to the crux of the
assurances that the Prime Minister gave to the Iwi Chairs in February this year – that there was
commitment to a Te Tiriti based relationship. There is no consultation with Iwi over many of the
matters that the Government is progressing. From our perspective, Te Tiriti trumps all and any
current or future Coalition agreements.
Finally, you’ve suggested that you’d like to meet for two hours. When you are ready, let us
know the time and location. The sooner we can book flights the better. We are waiting on
Orbit Travel to confirm the venue I would plan to be available from 11am to 1pm on
Tuesday 15th Oct in Auckland. I will get Paytyn to advise you as soon as she hears from
Orbit

Yes we are planning a full day session but want to spend a good amount of time on whanau
& community facing strategies that we believe needs to be devised in response to the
legislation on youth justice that is to be introduced.

-Tuesday meeting with Oranga Tamariki and Police (any follow up required? Robyn has
asked about access to copies of Cabinet papers) Yes please – we are keen to have access
to the Cabinet papers that relate to proposed changes to the Oranga Tamariki Act 1989. I
want to thank and acknowledge the officials that attended the meeting today. There are
some challenges that we will all face with the proposed legislation. The help and
assistance of Oranga Tamariki ILG & Pou Tangata was sought to be able to look at the
implementation of the legislation. We understood that this legislation is planned to be
enacted in March/April 2025.
Our assistance was sought without any committed resourcing forthcoming to Pou
Tangata (currently) for our joint work plan;
We appreciate the insights shared with us by OT about the Te Au Rere pilot but
there is a need for Pou Tangata to hui directly with Rangitane to hear their thoughts
and insights about the pilot programme they were running;
Together with OT, The Oranga Tamariki ILG & Pou Tangata want to be a part of
developing a communication plan and rollout about the proposed legislation out into
regions to observe and monitor.
