Official Information Act request dated 14 November 2024
We refer to your email dated 14 November 2024 requesting information under the
Official Information Act 1982 (the Act). The response to your request is set out below.
Request: I request all communications (including emails, texts, WhatsApp and signal
messages, summaries of any phone calls and summaries of any meetings)
sent/received by Jenny-May Clarkson between 1 July 2024 and 31 July 2024.
Response: Due to the broad nature of your request, we are unable to retrieve the
responsive information without substantial collation or research. Your request is
therefore declined in accordance with section 18(f) of the Act.
If there is a specific subject about which you would like information (for example, a
particular Breakfast story screened during that timeframe) please specify the
information you are requesting with due particularity in accordance with section 12(2)
of the Act (e.g. communications regarding a specific subject or key word like “annual
leave”).
To assist, we note that TVNZ’s internal news and current affairs operations are
commercial y sensitive, so requests for information about how we produce our news
and current affairs content are likely to be declined on the basis of section 9(2)(i) of
the Act: to enable TVNZ to carry out, without prejudice or disadvantage, commercial
activities.
In addition, and as this request has been made in relation to the information of one
individual, we remind you that the following sections may apply:
• section 4(c) of the Act which requires the protection of official information to
the extent consistent with the public interest and the preservation of personal
privacy;
• section 9(2)(a) which permits information to be withheld for the protection of
the privacy of natural persons; and
• section 9(2)(g) which al ows information to be withheld if withholding the
information is necessary for the protection of employees from harassment.
Please note that section 28 of the Act sets out the circumstances in which you may
make a complaint to the Ombudsman in order to seek an investigation and review of
this decision.
