We have had some follow up questions on any investigations etc. We will point journalists to our
statement last November (Referrals to Police | Elections) which relates to lack of promoter
statements on texts. We won’t be saying any more than this because it is an active investigation.
One of the allegations is that Marae staff were enrolling people while they did the census and
told them to go on the Māori roll. That’s not an offence if it did happen.
We do not appear to have had contracts with either Waipereira Trust, nor the Whānau Ora
Commissioning agency. We did contract some Whānau Ora clinics (providers not the
commissioning agency) to provide information and education.
We do provide enrolment forms to parties and others wishing to promote enrolment.
Police have contacted us to understand what we are investigating and we have said nothing
related is being looked at. They have had a complaint in relation to the matters in the story
above.

Further to my text late this afternoon, I attached a very early draft of the Terms of Reference for the
Inquiry into the
protection of personal information provided for the Census 2023 and immunisation purposes. We are seeking
your feedback on the aspects of the draft that relate to the Electoral Commission, specifically the “Out of Scope”
section.
Tracked changes or specific wording suggestions would be much appreciated. We would welcome your help to make
this as accurate and fit for purpose as possible.
Things are moving at pace, with the intention to finalise and publish the TOR by Thursday this week. To meet this
deadline, we will need your feedback by 12.00 noon tomorrow, Wednesday. Please send your response to our Deputy
Commissioner, Integrity Ethics & Standards,

I see in the news summary from Friday, that Chris Hipkins said (on Newstalk ZB) that if there was any
suspected improper (corrupt?) behaviour by a candidate that the EC ought to investigate that, and if so refer it to
Police.
Can we cover that off pls at some point - I guess there aren't a lot of retrospective options for us but it is a
troubling point.
We presumably wait to see what emerges from the various enquiries and then decide what to do - if there is
anything we can do under our mandate.

I asked stats NZ to address an error in the terms of reference. Attached is an update.
See paragraphs 7 & 8, which in the previous version implied we had made a referral to Police
about incentives to switch rolls. That was not correct. We only referred regarding the lack of a
promoter statement, and were not aware of incentives to switch rolls at that stage (which is not
an offence in the Electoral Act).
The version attached, and updated on their website, does not refer to the Electoral Commission
in paragraphs 7 & 8.
Our website and statements we have made are clear that it was a lack of a promoter statement
that was referred.
