Tēnā koe Malcolm,
Request for information
Thank you for your Official Information Act 1982 (OIA) request of 19 January 2025. You
asked for information regarding an Independent Police Conduct Authority (IPCA)
summary titled “South Island Police Officer investigated in relation to the acquisition of
firearms and access to Police computer systems”, which was published on the IPCA
website on 28 November 2024.
My response to each part of your request can be found below.
1.
What rank and position does the reviewing officer, who recommended no charges to
be laid, hold?
The decision in respect of criminal charges was made by the Criminal Charging Advisory
Panel. The Panel included two Assistant Commissioners (Assistant Commissioner:
Districts), a Superintendent (Director: Integrity and Conduct) and two National Legal
Counsel (Police Prosecution Service).
2.
What rank and position did the police officer who was investigated hold at the time of
the investigation
The officer held the rank of Constable. The officer’s position is withheld pursuant to
s.9(2)(a) OIA, to protect the officer’s privacy. Releasing the position of the officer would
increase the likelihood of the officer being identified.
Police considers the interests requiring protection by withholding the information are not
outweighed by any public interest in release of the information.
Please note that as part of its commitment to openness and transparency, Police
proactively releases some information and documents that may be of interest to the
public. An anonymised version of this response may be publicly released on the New
Zealand Police website.
You have the right to seek an investigation and review by the Ombudsman of this
decision. Information about how to make a complaint is available at
www.ombudsman.parliament.nz or freephone 0800 802 602.
Nāku noa, nā
Detective Inspector Kylie Schaare
