Thank you for your request under the Official Information Act 1982 (the Act) to the Ministry of 
Health – Manatū Hauora (the Ministry) on 18 February 2025. Responses to your questions are 
responded to in turn below: 
    •  Under what circumstances can the Minister of Health or other government officials 
intervene in Health New Zealand’s operations? 
 
The Pae Ora (Healthy Futures) Act 2022 and the Crown entities Act 2004 set out the roles 
Ministers have to intervene in relation to Health New Zealand – Te Whatu Ora (HNZ) and Crown 
entities more generally. 
  •  Have there been any ministerial directives, reviews, or interventions in the past 12 
months regarding hospital service delivery or governance? If so, please provide details. 
 
Hospital services are a component of the organisational model for HNZ. Therefore, any such 
reviews are mat er for HNZ. There have been no ministerial directives, reviews, or interventions 
in the past 12 months regarding hospital service delivery or governance by the Ministry. 
  •  What legal or procedural safeguards are in place to ensure Health New Zealand remains 
transparent and publicly accountable while operating independently of direct government 
control? 
 
HNZ must meet all the requirements of a statutory entity set out in the Crown entities Act 2004.  
HNZ is defined as a Crown agent this means it is not independent of Government Policy
