Official Information Act request: Antarctic Appointments
I refer to your request of 12 February 2024 to Deputy Prime Minister, Rt Hon Winston
Peters, requesting information about Antarctic Appointments and the swearing in ceremony
under the Of icial Information Act 1982 (the Act).
On 12 March 2025, your request was transferred in part under section 14 of the Act by the
Office of the Rt Hon Winston Peters to the Ministry of Justice (the Ministry), for response.
The part of your request transferred to the Ministry for response, is as follows:
… you talked about a sworn in process by MoJ, can you please explain how this
been done, is there a ceremony?
In response, I can advise that while we do not manage the appointment of “
Officers of the
Government of the Ross Dependency” my understanding is that all who fulfil that role are
first appointed as Justices of the Peace. In this case though, the appointment is valid only
while the person is in the Ross Dependency.
The swearing in ceremony referred to is the same one that all appointed Justices of the
Peace undertake (usually before a District Court Judge at the nearest Court). That involves
the Judge witnessing the oath of office which is a slightly different version to that applicable
to an “ordinary” JP and is on almost every occasion conducted in chambers (i.e. it is not a
public event).
A copy of the Ross Dependency version of the oath of office is attached for your information.
