Thank you for your request, received on 11 February 2016, for the following information
under the Official Information Act 1982 (the Act):
“A copy of any evaluation, review, report on, or audit of the Unitec “Transformation”
programme business case undertaken by the TEC. For the purpose of this request, singular
nouns also refer to the plural”.
The Tertiary Education Commission (TEC) is releasing three documents: an internal TEC
memorandum
Unitec Institute of Technology (Unitec) Application for Consent to Borrow; the
briefing
Unitec Institute of Technology (Unitec) Borrowing Consent Application;
and an aide
memoire
Update on Unitec’s Business Transformation Plans. In compliance with the Act the
TEC is withholding information from the documents to:
protect the privacy of natural persons [section 9(2)(a) of the Act]
protect information that would be likely unreasonably to prejudice the commercial
position of the person who supplied or who is the subject of the information [section
9(2)(b)(ii)]
the free and frank expression of opinions by or between or to Ministers of the Crown or
members of an organisation or officers and employees of any department or
organisation in the course of their duty [section 9(2)(g)(i)]
enable a Minister of the Crown or any department or organisation holding the
information to carry on, without prejudice or disadvantage, negotiations (including
commercial and industrial negotiations) [section 9(2)(j)].
Redactions are clearly marked in the documents and referenced in the attached table. I am
satisfied, in terms of section 9(1) of the Act, that the need to withhold the information referred
to above is not outweighed by other considerations that render it desirable, in the public
interest, to make the information available.
Please note that paragraph 47 in the Memorandum incorrectly refers to VUW, and the
reference to VUW should be taken to refer to Unitec.
