Re: Monitor of Resource Consent Conditions
I refer to your email, which we received on 15 February 2016, requesting information about Monitor of
Resource Consent Conditions.
The conditions referred to in your request exist in the Northern, Western, and Southern areas, with
none in Central. We do not have any way to report on the number of properties subject to such a
condition.
Some conditions of consent require a consent notice or covenant to be registered stating when a
dwelling is to be vacated or removed. The consent is considered completed once the consent notice
or covenant has been registered on the Certificate of Title and any other conditions have been met.
Consents are monitored until completion, ensuring all conditions of consent are adhered to, and full
compliance is reached.
Generally, a completed consent is not routinely monitored.
Reports of non-compliance with consent conditions, covenants, or consent notices from staff or
members of the public will be investigated on a case-by-case basis, with appropriate enforcement
action taken if necessary.
Should you believe Auckland Council has not responded appropriately to your request, you have the
right by way of complaint, under section 27(3) of the LGOIMA, to apply to the Ombudsmen to seek an
investigation and review of the decision.
