Dear Mr McCall
REQUEST FOR INFORMATION
Thank you for your request for information dated 15 March 2016 under the Official
Information Act 1982 (“OIA”).
You asked for a copy of the final signed contract for the following study that was tendered by
PHARMAC through the Government Electronic Tenders Service (GETS):
'Supply of Quantitative Research and Analysis Services' RFx ID: 15051734
Please find attached the document you requested. We have redacted some information from
the contract in accordance with the OIA as we consider this necessary to:
(under 9(2)a)): “protect the privacy of natural persons”;
(under 9(2)(b)(ii)): ”protect information where the making available of the information
would be likely to unreasonably prejudice the commercial position of the person who
supplied or who is the subject of the information”; and
(under 9(2)(ba)(i)): “protect information which is subject to an obligation of
confidence…where the making available of the information would be likely to
prejudice the supply of similar information, or information from the same source, and
it is in the public interest that such information should continue to be supplied”.
As required under the OIA, we considered whether the public interest in releasing the
redacted information outweighs the reasons for withholding it (as identified above). We did
not consider this to be the case in this instance.
Please note you have the right, by way of complaint under section 28(3) of the OIA to an
Ombudsman, to seek an investigation and review of our decision.
We hope that this information is of assistance. Please do not hesitate to contact us again
should you have any further questions.
Yours sincerely
Peter Alsop
