Official Information Act #16.150 – Homeopathic Products
1.
We refer to your Official Information Act 1982 (OIA) request of 16 March 2017 and
follow up email of 13 April 2017.
2.
You have resubmitted to the Commission your request for information on whether
“in the commissions opinion, the act of selling products by pharmacies that have no
scientific basis to their claims is misleading to consumers”.
3.
In response we can advise that the subject matter of your request is not an issue that
the Commission has investigated any trader for previously, and as such, we are
unable to provide a general view or any information beyond what we provided to
you in our letter dated 13 April 2017.
4.
As you are aware, it is a breach of the law for any trader to make claims that are
false, misleading or unsubstantiated. When investigating the Commission considers
the available facts of the particular case before deciding whether it is likely that the
trader has breached the law.

If you are not satisfied with the Commission's response to your OIA request, section
28(3) of the OIA provides you with the right to ask an Ombudsman to investigate and
review this response.
