Thank you for your email of 8 November 2017 requesting the following information under the Official
Information Act 1982 (the Act):
I.
Please provide a list and purchase details of properties which have been acquired as part of
the East West Link Project. This should include properties that are or were under contract but
may not or will not settled, for whatever reason.
2. Please provide a list and option details of properties that currently or previously had options to
be acquired as part of the East West Link Project.
I have responded to the two parts of your request in turn below.
Please provide a list and purchase details of properties which have been acquired as part of the
East West Link Project. This should include properties that are or were under contract but may
not or will not settled, for whatever reason.
With regard to 'purchase details', I have interpreted this to mean the property address and purchase
price (including GST status) of these properties. This excludes any amounts paid for temporary
occupation, additional compensation, reimbursements and professional fees, where applicable.

subject of the information. With respect to the information that has been withheld, I do not consider
there are any other factors which would render it desirable, in the public interest, to make the
information available.

1-7 and 19-21 Sylvia Park Road
There is a Heads of Agreement between the landowner of 1-7 Sylvia Park Road and 19-21 Sylvia Park
Road and the Transport Agency for the acquisition of these two properties. Under the Heads of
Agreement the Transport Agency has agreed to promote the acquisition of the properties to the
Minister for Land Information, who is responsible for the acquisition of any land under the Public Works
Act 1981. The compensation is not agreed in that Heads of Agreement, but is left for further
negotiation. As such, this part of your request is refused under section 18(e) of the Act, as the
purchase price does not exist.
Under section 28 of the Act, you have the right to ask the Ombudsman to review my decision to
refuse this part of your request.
