Re: Communication prior to meeting on Notice of Motion
I refer to your email, which we received on 1 March 2018, requesting information about
communication to the SPCA and others prior to the meeting on the Notice of Motion relating
to the proposed fireworks ban.
Please provide all communications between Auckland Council and SPCA regarding
fireworks between 2015 and now
Please see attached a copy of the correspondence identified between Auckland Council and
SPCA between January 2015 and February 2017. Please note some information has been
withheld in accordance with section 7(2)(a) of the Local Government Official Information and
Meetings Act 1987 (the Act), to protect the privacy of people involved.
In addition to the correspondence provided, two emails between Auckland Council and
SPCA have been identified as relating to event permits in 2015 and 2016. The event permit
form mentions “fireworks” as default wording, however is not related to the topic of your
request. As such, these emails has not been provided in the attached correspondence.
Please provide all information regarding fireworks complaints received by Cr Cathy
Casey and Cr Fa’anana Efeso Collins
Cr Collins had informal, in person conversations with members of the public regarding
fireworks. Cr Casey has not received any fireworks complaints. Accordingly this part of your
request for information is refused under section 17(e) of the Act, as the document alleged to
contain the information requested does not exist.
Is Cr Casey a member of ‘Ban the Boom’ and has she posted on their pages regarding
the firework sales ban?
Cr Casey is not a member of “Ban the Boom NZ” Facebook page.
After her Notice of Motion was accepted for the Governing Body meeting in February 2018,
Cr Casey posted it on her own Facebook pages. The administrator of the “Ban the Boom
NZ” Facebook page saw the post and contacted Cr Casey via Facebook asking permission
to copy and share it. Cr Casey added comments to these posts to share further information
regarding her Notice of Motion.

Please refer to Sarah Parry-Crooke’s letter of 29 March 2018, for Official Information
Request No. 8140002601. This letter details the process for making any amendments to a
bylaw, including consideration of the New Zealand Bill of Rights Act 1990 and other factors.
Please provide all communication to the firework industry, prior to the [Governing
Body] meeting [on 22 February 2018]?
There was no communication between the Governance Advisor team (responsible for the
organisation and management of Governing Body meetings) and the fireworks industry prior
to this meeting. Accordingly this part of your request is refused under section 17(e) of the
Act.
Should you believe Auckland Council has not responded appropriately to your request, you
have the right by way of complaint, under section 27(3) of the LGOIMA, to apply to the
Ombudsman to seek an investigation and review of the decision.
