Thank you for your email of 19 March 2018 in relation to our 13 March 2018 response (18-E-
0094) to your request under the Official Information Act (the Act).
Your email notes that according to our 13 March 2018 response, “
the quantity of 1080 poison
baits loaded in the car park at 20 Joan Gaskell Drive, Whitianga between 7-10 pm on 17
October 2017 was 22,800 kg”. In this context you asked for the following information under
the Act:
1. Who was contracted for security purposes: e.g. was it R S P Lane or was
it VIP Security Consultants Ltd?
2. Who was the employer of the security personnel: eg. was it DoC
Hauraki?
3. In what capacity was R S P Lane or VIP Security Consultants Ltd
contracted by DoC: eg. security guard.
4. Who was responsible for the actions of R S P Lane or VIP Security
Consultants Ltd on 17 October between 7-10 pm: eg. was it Steven Bolton,
ranger for the Papakai operation?
5. Was R S P Lane or VIP Security Consultants Ltd an agent of the Crown
on 17 October between 7-10 pm?
Clarification of information provided in 13 March 2018 response
I note that our response of 13 March 2018 provided you with a Hazardous Substance Tracking
document which showed the total quantity of 1080 sodium fluoroacetate 0.15% (bait) that
was delivered to 2/20 Joan Gaskell Drive. Our response also clarified that the bait was
delivered to a warehouse used by the Department for storage at 2/20 Joan Gaskell Drive,
Whitianga, not to the Liquor King shop in Whitianga at 20 Joan Gaskell Drive as provided in
your request.
Our response did
not advise that the bait was “
loaded in the car park at 20 Joan Gaskell
Drive, Whitianga between 7-10 pm on 17 October 2017”. It also did not advise that anyone
was contracted for security purposes. I believe it is important to clarify that these specific
details were not provided to you by the Department.
Our response
In response to your request, I am able to advise that Exim Properties Limited carried out
security services to the Department for the duration of the bait delivery operation to 2/20
Joan Gaskell Drive on 17 October 2017. Exim Properties Limited invoiced the Department for
these services.

This does not mean that Exim Properties Limited were employed by the Department as
queried in your request. Exim Properties Limited are the employers of their own staff. As
such, Exim Properties Limited are managers of and responsible for their own staff.
I am unable to provide you with information in relation to whether Exim Properties Limited
was “
an agent of the Crown on 17 October 2017 between 7-10 pm” as this information is not
held by the Department. This decision is made under section 18(g) of the Act.
You are entitled to seek an investigation and review of my decision by writing to an Ombudsman
as provided by section 28(3) Official Information Act 1982.
