Dear Mr Joseph
I refer to the email of 14 September 2018 you sent to the New Zealand Police.
Your request was made pursuant to the Official Information Act 1982, and
specifically requested:
1. Police manual chapters relating to public photography/filming in public
2. Police manual chapters relating to the act peeping and peering in[to] a dwelling
house.
Upon clarifying with you on 08 October 2018, you stated that you were seeking
information around individuals, not police, photographing and filming in public,
and peeping and peering into a dwelling house.
My response is as follows.
1. Police manual chapters relating to public photography/filming in public
The information you are after pertains to statutes governing the conduct of the
general public in New Zealand, and is therefore not held by Police. As such, I am
declining this request under Section 18(e) of the Official Information Act 1982 in
that the document alleged to contain the information does not exist, or cannot be
found.
2. Police manual chapters relating to the act peeping and peering in[to] a
dwelling house.
Police do not have a Police manual chapter relating specifically to the act of
peeping and peering into a dwelling house as this falls under the Summary
Offences Act 1981 which is publically available.
In an effort to assist you, however, I am enclosing a Police manual chapter on
Burglary and allied offences, which makes reference to peeping or peering into a
dwelling house.
You have the right, under Section 28(3) of the Official Information Act of 1982, to
request the Ombudsman to review my decision if you are not satisfied with my
response to your request.
