REQUEST FOR OFFICIAL INFORMATION – DECISION TO REFUSE
We refer to your official information request dated 30 October 2018, for the costs associated with
enforcing a breach of consent.
Due to the substantial amount of work that is required to research and collate the information you
have requested, we are refusing your request under section 17(f) of the Local Government Official
Information and Meetings Act 1987 (LGOIMA). The rationale for our refusal is that if we were to
quantify the costs associated with enforcing a breach of a consent, we would need to conduct a
research project which looks at the amount of personnel time spent enforcing breaches and the costs
associated with the time spent. In addition, we would need to quantify the costs of other resources
expended (aside from personnel) when enforcing consent breaches.
We have considered whether charging or extending the timeframe for responding to your request
would help, as required by section 17(A) of the LGOIMA; however, an extension of time would not
help in this case, because the type of research project necessary to answer your query cannot be
incorporated into Queenstown Lakes District Council’s busy work program at this point in time.
We have decided that consultation with you on this matter (as required under section 17B of the
LGOIMA) would not assist you to resubmit your request in a form that would remove our reason for
refusal. For instance, while you could be more specific in relation to the type of consents you’d like
costs quantified for, we still think that even if you were more specific, there would still be too much
work involved in quantifying the associated costs of the specific type of consents you are interested
in.
You have the right to seek an investigation and review by the Ombudsman of this decision.
