Thank you for your email of 6 December 2018, requesting CCTV footage of a driving incident which 
occurred on 3 December 2018 under the Official Information Act 1982 (the Act). As the applicable 
CCTV cameras are maintained  by the NZ Transport Agency, your request was referred to our office for 
response by Auckland Transport on 10 December  2018.  
 
In particular, you have requested the fol owing information:   
There was an accident that occurred December 3 (Monday) around 8:55AM-9:05AM  in Green 
Lane East coming from the Southern  Motorway.  A  white lory truck  hit an orange Honda Fit 
while  at the giveway  area near the roundabout.  The police will  be making the arrangements 
for  the CCTV  footage as a report is already filed.  Thank you for  your  assistance. 
 
The CCTV system is designed to overwrite existing footage every three to seven days, depending on 
location. Unfortunately, as the Transport Agency received your request more than seven days after the 
time of the incident, the relevant footage has not been retained. Your request has therefore been 
refused under section 18(e) of the Act as the information does not exist. 
 
Under section 28 of the Act, you have the right to ask the Ombudsman to review my decision to refuse
