Thank you for your email dated 17 February 2019, requesting information about
the current policies
Auckland Transport (AT) have for issuing infringements to vehicles parked il egally on footpaths.
The offence ‘Parked on a Footpath or Cycle Path’ is a safety based offence as footpaths are
designed for pedestrians and not vehicles.
AT follows this safety based offence from the National Schedule of Offence Penalties & Regulations.
A warranted parking officer wil issue an infringement while they are on regular patrol, or after
receiving a request for service (complaint).
Al requests for service are responded to by a warranted parking of icer.
There are several vehicle classes that have a general exemption form this offence.
• A glass pane delivery vehicle where safety must be observed for all user groups in the safe
delivery of large panes of glass
• Case impressment vehicles, where banks are transferring funds. Close proximity and direct
camera views are required. This is an overall safety issue, reduction of armed robbery
potential
• Armed defender squad vehicles
• Diplomatic Protection Squad
• Diplomatic vehicles within a motorcade
• Emergency service vehicles in the act of service delivery. e.g. Fire, Ambulance, Police etc.
There may be other justifying circumstances that would be dealt with on a case by case basis for
private vehicle use, e.g. immediate health emergency (a member of the public having a heart
attack).
We trust the above information has addressed your request however should you believe that we
have not dealt with your request appropriately, you have the right in accordance with section 27(3)
of the LGOIMA to make a complaint to the Office of the Ombudsman and seek an investigation and
review in regard to this matter.
