REQUEST FOR INFORMATION
I refer to your request dated the 2nd of April 2019 via email at 10.39 am in which you
requested the following information:
All material on file relating to a complaint made by Carmen Gregory to the NZ Police
and pertaining to AR Henry who was the subject of the complaint. You also
requested all material submitted to the IPCA ref 18-1952.
I have considered this request and will respond to it under the Official Information Act
1982 and the Independent Police Conduct Authority Act 1988.
The request for information submitted to the Authority is declined pursuant to s 32 of
the Independent Police Conduct Authority Act 1988. Due to the nature of this
investigation, i.e. an Independent Police Conduct Authority (IPCA) Complaint, Police
are unable to provide this information. This is because this information was
generated by the Police as a result of your complaint specifically for the IPCA and for
no other purpose and under the Independent Police Conduct Authority Act 1988,
therefore it is not discoverable, since it is regarded as property belonging to the
IPCA.
Section 32 of the Act relates to the Authority (IPCA) and staff to maintain secrecy (1)
The Authority, every member of the Authority, and every person holding any office or
appointment under the Authority, shall maintain secrecy in respect of all matters that
come to their knowledge in the exercise of their functions, and shall not
communicate any such matter to any person except for the purpose of carrying out
their functions under or giving effect to this Act.
I have attached the following information as per your request;
• A copy of the infringement notice ;
• Copies of photos supplied as part of the complaint;
• Copy of Carmen Gregory’s statement;
• Copy of the complaint received;
Police have supplied all the information available as per your request and disclosure
is attached.
If you are not satisfied with my response to your request, you have the right under
Section 28(3) of the Official Information Act 1982 to complain to the Office of the
Ombudsman and seek an investigation and review of my decision.
