Response to this request is long overdue. By law Ministry of Economic Development should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

Dear Ministry of Economic Development,
The Minister for Commerce Hon Craig Foss has confirmed that the Insolvent Debtors Relief Act 1729 is still in force in New Zealand and the the Official Assignee has no power to override that Act. Therefore if the Insolvent Debtors Relief Act 1729 (Set-Off Act) is still in force in New Zealand, why are debts owed by a legatee to the executor of a mutual deceased estate still considered provable in insolvency by the Official Assignee.
