Dear Mr Montgomery,
Official information request for Asbestos Management Plans prepared under
Regulation 13(2) of the Health and Safety at Work Regulations 2016.
I refer to your official information request dated 3 February 2020 for
“Copies of all Asbestos Management Plans prepared under Regulation 13 (2)
of the Health and Safety at Work (Asbestos) Regulations 2016 for all
workplaces occupied or from time to time occupied by the Waikato District
Health Board where asbestos or ACM (Asbestos Containing Material) is
suspected to be or has been identified at the workplace”.
Under the Official Information Act 1982 (the Act), Waikato DHB may impose charges
for the time taken and resources used in dealing with a request. At present we
generally charge where a request is likely to take more than 4 hours for a member
of
the public or 8 hours for MPs.
Your request has been identified as one likely to take this amount of time and
accordingly we intend to invoice you for the request. At this stage it is estimated that
your request will incur the following costs:
Staff time searching for relevant material: 40 hours (minus 4 hours free)
Rate: $38/half hour (as per Ministry of Justice guidelines)
Total Charge: $2736.00.
Please note that this is only
an estimate, and that actual charges payable will
depend on the actual time taken and costs incurred.
Please contact me to confirm that you wish to proceed with your request. If you do,
you will be invoiced on completion of the request.
We will defer responding to your request until we receive confirmation from you that
you wish to proceed. If you choose not to proceed or wish to alter your request in any
way, please let us know as soon as possible.
In the meantime, we enclose the DHB overarching Asbestos Management Plan
which sets out the DHB’s expectations in meeting the duties imposed by Regulation
13 (2) of the Health and Safety at Work (Asbestos) Regulations 2016.
In addition, I have also enclosed a sample excerpt from the Waikato DHB Asbestos
Register. This provides an example of how a multitude of plans and monitoring is
embedded for each of the numerous buildings across our estate in which Asbestos
Containing Material is suspected and / or identified and is being managed under the
Policy and overarching Plan.
You have the right to seek an investigation and review of the Ombudsmen of the
