Ministry of Justice
Hi James
Thank you for your OIA request for "all documents relating to, or which mention, declarations of inconsistency." In its current form, without any time parameters and necessarily including emails and documents that might mention declarations simply in passing, your request is very large and we would likely refuse it under section 18(f) of the Act on the grounds that it would involve substantial collation and research.
However, we would like to request, under section 15 of the Act, if you would agree to narrow the scope of your request to all briefings, aides memoires and reports about declarations of inconsistency provided to the Minister of Justice since the current Government was sworn in on 26 October 2017.
We look forward to your response.
Kind regards
Antony Paltridge

Thank you for responding to our request to narrow the scope of your request to: "all briefings, aides memoires and reports about declarations of inconsistency provided to the Minister of Justice since the current Government was sworn in on 26 October 2017."
Under section 14(b)(ii) of the Act, I am transferring your request to the Minister of Justice, Hon Andrew Little, as the information you have sought is more closely related to the functions of the Minister.
If you are not satisfied with my decision to transfer your request, you have the right to complain to the Ombudsman under section 28(3) of the Act. The Ombudsman may be contacted by email at [email address].

Tēnā koe Mr Watson
Official Information Act request: Declarations of inconsistency
Thank you for your email of 19 March 2020 to the Ministry of Justice
requesting, under the Official Information Act 1982 (the Act), information
about declarations of inconsistency. On 26 March 2020 you agreed to narrow
the scope of your request to:
"all briefings, aides memoires and reports about declarations of
inconsistency provided to the Minister of Justice since the current
Government was sworn in on 26 October 2017."
On 30 March 2020, the Ministry transferred to the Minister of Justice to
respond.
While a response to your request is currently being prepared, given the
substantial information that might need to be collated and considered, and
with the level 4 COVID-19 lockdown limiting the ability of our Office to
do this, a response cannot be reasonably made within the original time
limit of 28 May 2020. Accordingly, we are extending the time limit for
response to your request under section 15A of the Act and will respond to
you by 30 July 2020.
If you are not satisfied with my response to your request, you have the
right to complain to the Ombudsman under section 28(3) of the Act. The
Ombudsman may be contacted by email at [email address].

Please note information about meetings related to the Ministers’
portfolios will be proactively released (this does not include personal or
constituency matters). For each meeting in scope, the summary would list:
date, time (start and finish), brief description, location, who the
meeting was with, and the portfolio. If you attend a meeting with the
Minister on behalf of an organisation, the name of the organisation will
be released. If you are a senior staff member at an organisation, or meet
with the Minister in your personal capacity, your name may also be
released. The location of the meeting will be released, unless it is a
private residence. The proactive release will be consistent with the
provisions in the Official Information Act, including privacy
considerations. Under the Privacy Act 1993 you have the right to ask for a
copy of any personal information we hold about you, and to ask for it to
be corrected if you think it is wrong. If you’d like to ask for a copy of
your information, or to have it corrected, or are concerned about the
release of your information in the meeting disclosure, please contact the
sender. You can read more about the proactive release policy at
