Dear Andrew Little,

Can you please forward all information held by the Government which details how your proposed Maori Health Authority - will comply with New Zealand's obligations under local & international law to provide 'everyone' with adequate health and medical care?

It is concerning that we have people in New Zealand who can not afford to visit the doctors or pay for their prescriptions. Surely the scope of any new authority worth investing in - should be broad enough to cover the interests of 'all' impoverished people?

While a specific race based authority is compliant with section 19(2) of the Bill of Rights Act - it would be discriminatory to not also create a similar authority for all other races.

It is a misnomer and an offensive racial stereotype to suggest that 'all Maori' are disadvantaged. The Bill of Rights indicates that a Maori Health Authority should not provide greater access to health services for Maori people who are affluent (i.e. not disadvantaged). It would only be able to assist affluent people with services for which they are genetically predisposed.

Hi Andrew,

I should say - I'm not sure if a specific race based authority is compliant with section 19(2) of the Bill of Rights Act - or even the United Nations Declaration on the Rights of Indigenous Peoples.

I'm sure you have done due diligence on researching the overlap of these laws with everyone's right to equal access to health care.

Tomorrow is the deadline for this request.

As mentioned in a separate email - New Zealand is a signatory to the:
International Convention on the Elimination of All Forms of Racial Discrimination

As advised - the CERD confirms that any special race based priorities must be based on 'need' and cannot remain in place indefinitely.
(I won't charge for this)

Given the Labour party's lack of practicality - I will assume there has never been any effort made to ensure your policies comply with New Zealand's obligations under international law.

Also due to the Labour party's lack of transparency - I will assume that if any effort was made - the information will never be released to the public.

It seems this particular majority government - does not feel the need to comply with the official information act.

On this basis I will withdraw the request.

Hi Andrew,

I would just to like further set out my concerns about the dangers of blanket prioritization and how it will inevitably lead to discrimination.

The push seems to be coming from a widespread belief that 'all' Maori are poor and live in squalid conditions - therefore all Maori should receive priority when it comes to healthcare. On this basis the Labour government appear to be wanting to roll out blanket race based prioritization and the Ministry of Health appear to be on board with this. A report from RNZ indicates the government's Covid 19 Immunisation Implementation Advisory Group was effectively stacked with people who would help achieve this outcome:

"To achieve equity, the Ministry of Health is designing a service that provides for groups the system has often failed to reach, such as Māori in remote rural areas."
Five of the 12 members on the Implementation Advisory Group are Māori including Te Puea Winiata, Nicky Birch, Taima Campbell, Kevin Pewhairangi and Dr Rawiri Jansen, who were chosen by the Director-General

In another report your Associate health minister Peeni Henare said the structure was already in place to be able to vaccinate vulnerable whānau, to "prioritise kaumātua, kuia, we've carved out provision there for Māori".

There appears to be evidence that blanket prioritization of the vaccine is already occurring and prioritization is being given regardless of a persons individual health & lifestyle circumstances. This seems to be having a dangerous impact on people who likely should have been prioritized ahead of at least some of the people the Labour government appear to be giving blanket prioritization to.

The reality is a lot of Maori have good jobs and live in nice homes, with nice cars - can afford to go to a doctor and can even afford expensive cosmetic treatments (hairstyling, botox etc) if they so choose.

The below comments from a recent Twitter thread from Shane te Pou potentially gives us an insight into how the Labour party's blanket prioritization policy seems to be working now and what we can expect in the future in other areas of health as the health system gets stretched. Your letter states:
"section 19 of the New Zealand Bill of Rights Act, which also provides that action taken to assist disadvantaged groups does not constitute unlawful discrimination"

I have been very clear in saying that I believe only Maori who are not financially well off - meet the commonly accepted description and meaning of 'disadvantaged'. If the transparent Labour Government holds evidence which proves otherwise - it will have no issue including that in the information.

Your Government has pointed to obligations under the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) - as the reason for establishing a separate Maori Health Authority.

However New Zealand is also signatory to the International Convention on the Elimination of All Forms of Racial Discrimination. https://www.ohchr.org/en/professionalint...

Of particular interest is Article 1 (4):

Special measures taken for the sole purpose of securing adequate advancement of certain racial or ethnic groups or individuals requiring such protection as may be necessary in order to ensure such groups or individuals equal enjoyment or exercise of human rights and fundamental freedoms shall not be deemed racial discrimination, provided, however, that such measures do not, as a consequence, lead to the maintenance of separate rights for different racial groups and that they shall not be continued after the objectives for which they were taken have been achieved.

Please note information about meetings related to the Ministers’
portfolios will be proactively released (this does not include personal or
constituency matters). For each meeting in scope, the summary would list:
date, time (start and finish), brief description, location, who the
meeting was with, and the portfolio. If you attend a meeting with the
Minister on behalf of an organisation, the name of the organisation will
be released. If you are a senior staff member at an organisation, or meet
with the Minister in your personal capacity, your name may also be
released. The location of the meeting will be released, unless it is a
private residence. The proactive release will be consistent with the
provisions in the Official Information Act, including privacy
considerations. Under the Privacy Act 1993 you have the right to ask for a
copy of any personal information we hold about you, and to ask for it to
be corrected if you think it is wrong. If you’d like to ask for a copy of

Dear Andrew Little,

Thank you for your response to this request:

"1. Please forward all information held by the Government which details how your proposed Maori Health Authority - will comply with New Zealand's obligations under local & international law."

Your response confirms that NO WORK has been undertaken to ensure the proposed Health Authority will comply with obligations under local & international law (this will be an afterthought).

ANDREW LITTLE (response):
"The changes to the health system operating model will require legislation to restructure the public owned health and disability system. This will include provisions to establish new entities, including the Authority and disestablish others. The legislation to enact the new entitles will be the subject of a detailed examination by the Ministry of Justice for compatibility and compliance with relevant legislation before it is introduced the House."

To my knowledge there has also been no public consultation on your proposed authority. The documents you have forwarded indicate all decisions have been made by what is referred to as the 'Social Wellbeing Committee'. This appears to be the Social Wellbeing Committee:

Quite the diverse range of views & opinions there I'm sure. Very democratic.

It would be tragic if a person were to die because they were bumped down a list due to another person being prioritized based on race without sound evidential reasoning. Even more tragic if children end up being affected by ludicrous and ill thought through government health policies.

Given the increasing strain the health system is under - it will only be a matter of time before these issues start appearing if we do not have an ethically sound system -
