Thank you for your email of 26 October 2021, asking for the following information under the Official
Information Act 1982 (the Act):
1.
I wish to request information if compensation payments are made to families who have had
loved ones suffer a major reaction from the Covid Vaccination.
2.
Are compensation payments made to families who have had loved ones die as a result of the
Covid Vaccination - or die shortly after the Covid Vaccination?
3.
If so - can you please share this amount with the public.
ACC cover for treatment injuries related to the COVID-19 vaccine
A physical injury resulting from the COVID-19 vaccine may be covered by ACC if the criteria for
treatment injury are met. The following outlines how we assess applications for cover for treatment
injuries:
1. Determine whether the client has suffered a personal injury.
2. Assess whether the personal injury occurred within the context of treatment by or at the
direction of a registered health professional.
3. Determine if there is a direct causal link between the treatment (ie, in these circumstances, the
vaccination) and the personal injury.
4. Determine whether the injury was a necessary part or ordinary consequence of treatment.
As at 16 November 2021, no claims for fatalities in relation to the COVID-19 vaccination had been
lodged with ACC.
Necessary Part or Ordinary Consequence of Treatment Policy
The attached document titled
Necessary Part of Ordinary Consequence of Treatment Policy is used when
assessing a treatment injury claim to help determine whether the injury suffered by a client was a
necessary part or ordinary consequence of the treatment provided.
