Dear Information Request,
There are emails contained within this most recent OIA which should have been subject to previous OIAs.
Can you please advise why these were not provided previously?
Can you please review your previous responses to ensure that all information requested previously has been supplied as you are legally obligated to do.
This has been an incredibly difficult process for what should have been a very straight forward request.
Yours sincerely,
Wayne Scott
From: Wayne Scott
Dear Information Request,
Further to this, the most recent response references a 1971 agreement which was also requested in previous OIAs.
You previously stated that the original meeting was organised by telephone, this most recent response clearly shows that the meeting was organised via email.
This is a clear and blatant breach of QLDCs legal obligations under the LGOIMA.
I would suggest you escalate this matter. I have. O further options available but to refer this to the Ombudsman as there have been continued and repeated breaches of your legal requirements for reasons unknown.
Yours sincerely,
Wayne Scott

Dear Information Request,
Please widen your scope and check with staff.
This seems like you are intentionally seeking to withhold information. Especially as it appears staff who have sent emails have been privy to these OIA

Hi Wayne,
Our searches did not find any agreement related to Pigeon Island hut for 1971 as requested, and whilst terms of occupation were discussed we believe a document was never generated. The occupation remained very informal from the start.
We are unable to provide any information in regards to the 1971 agreement. We therefore decline this part of your request under section 17(e) of the Local Government Official Information and Meetings Act 1987 (LGOIMA). Section 17(e) of the LGOIMA provides that the document alleged to contain the information requested does not exist or, despite reasonable efforts to locate it, cannot be found. In this case, to address your correspondence request, we performed an archive search for this document but we were unable to locate any and therefore have to decline this part of your request.
We don't have anything further to provide on this matter.
Right to review the above decision
Note that you have the right to seek an investigation and review by the Ombudsman of this decision. Information about this process is available at www.ombudsman.parliament.nz or freephone 0800 802 602.
If you wish to discuss this decision with us, please contact [email address] (Governance & Stakeholder Services Manager).
We trust this response satisfactorily answers your request.

Dear Information Request,
Your earlier response clearly states that the original 1971 agreement had a three month termination clause.
It seems implausible that this termination clause would have been known unless there was a copy of the agreement or some form of documentation that confirmed this.
Yours sincerely,
Wayne Scott
