[FYI request #20171 email]
Dear Steven
I refer to your Official Information Act 1982 (OIA) request dated 8 August 2022, in which
you requested the following information:
Can Police break the driving laws of NZ without any flashing lights on? If so can
you give me a link to read about it?
The Land Transport (Road User) Rule 2004(the Rule) provides a general exception which
police officers may rely upon in circumstances where they would otherwise be breaching
the Rule.
I refer to you Part 1.8(3)(b) of the Rule. A copy of the Rule is available to view here:
https://www.legislation.govt.nz/regulation/public/2004/0427/latest/DLM303038.html
Your request is therefore refused pursuant to section 18(d) of the OIA as the information
requested is publicly available.
If you are not satisfied with the way I have responded, you have the right, under section
28(3) of the OIA, to ask the Ombudsman to review my decisions. Information about how
to do this is available a
t ombudsman.parliament.nz
Yours sincerely
