Benefits of the CPA reform process

Dear Ministry of Justice,

At paragraph 45 of the Departmental Report for the Justice and Electoral Committee on the Criminal Procedure (Reform and Modernisation) Bill, the Ministry of Justice estimated that benefits from the proposed reform would include (although I cannot find the time frame used):
1. 43,000 fewer court events;
2. 1,000 to 1,400 fewer cases being designated for trial by jury (resulting in 350 to 1,400 additional cases at judge alone case review – equivalent to a status hearing); but
3. 1,100 to 3,300 fewer cases that require either a Judge-alone or jury trial (including 820 to 2,700 fewer cases requiring a Judge-alone trial and 300- 600 fewer cases requiring a jury trial).
At paragraph 47, Fiscal benefits were estimated to amount to $24.3 million over a five year period, using a discount rate of 8%, and $80.7 million over ten years, using the same discount rate, assuming that all of the reforms were implemented. While the CPA 2011 did not include all of the reforms, it did include most of them.

Please provide the following information:

1. What was the time frame used for the above predictions; and
2. How close were these predictions to reality, notwithstanding the changes between the bill and the act; and
3. Were there fewer or more court events in the above time period after the start of the CPA 2011, and if so how many more or fewer;
4. What were the actual numbers for points 2 and 3 above over the same time period; and
5. Any reports, aide memoires, memoranda, minutes, or any other recording that reviews, analyses, assesses, or comments, upon of the Criminal Procedure Act 2011 between the date of implementation and today.

J. Beddek left an annotation ()

You may want to complain to the Ombudsman. Two requests delayed for over a month without any communication about the extension time is not very forthcoming and appears to be in violation of the Act.

Section 15A(4)(a) of the Act states "The notice effecting the extension shall [..] specify the period of the extension"
