Special direction – Grant of work visas to a class of offshore persons whose post-study work visas have expired

Dear Ministry of Business, Innovation & Employment,
This is regarding the selection criteria published by INZ under the special direction 12 - Months open work visa granted to previous holders of Post Study Work Visas who missed out because of the border closure in 2020-21 during the COVID-19 pandemic.
Accordingly, there are the two criteria given by INZ for the eligibility selection.
(1) If you held a PSWV;
You meet the criteria if you held a PSWV on 19 March 2020 and you:
-were not in New Zealand on 19 March 2020
-are not currently in New Zealand
-do not hold another valid New Zealand visa.
(2) If you were granted a PSWV;
You meet the criteria if you were granted a PSWV between 19 March 2020 and 10 August 2020 (inclusive) and you:
-were outside New Zealand
-are not currently in New Zealand
-do not hold another valid New Zealand visa.
Now, my query is, whether a person with following situation meets the first criteria;
If a person had applied for a PSWV from out of NZ, and he/she had been duly granted the PSWV before the border closure on 19 March 2020 while he/she was still out of NZ. That PSWV has been granted to him/her with a grace period for him/her to enter NZ within three months time. But he/she was unable to enter NZ before the given deadline due to the border closure effected on 19 March 2020. Now if,
-He/ She was not in NZ on 19 March 2020,
-He/ She is not currently in New Zealand
-He/ She does not hold another New Zealand visa.
Does that person meet the first criteria or not?
