Thank you for your Official Information Act (OIA) request of 20 May 2023:
Related to the Agricultural Compounds and Veterinary Medicines Amendment
Act 2007.
Please provide all compounds listed by the director General as exempt
under section 8B and section 8C. Please also provide any relevant
conditions or regulations imposed with their use.
You have requested a large amount of information that we are unsure we can
process. Under section 8C, there have been roughly 100 approvals each
year. Each approval would need to be manually checked to see if it can be
released as each may have to be withheld for commercial sensitivity
reasons. The time it will take to review, collate, and assemble that
information for release to you is substantial and will not be able to be
completed without it impinging on our ability to meet other obligations we
have. As your request stands at present, it is likely to be declined under
section 18(f) of the OIA which applies where the information cannot be
made available without substantial collation or research.
Are you able to refine your request? For example, are you interested in
approvals from a certain time period? Are you interested in certain
compounds? Are you interested in certain uses?
If you’re able to provide any context around why you are making this
request, it will help us to provide you with relevant information.

Thank you for your official information request of 20 May requesting
details of exemptions made under the Agricultural Compounds and Veterinary
Medicines Act 1997 (the Act). Your request has been considered under the
Official Information Act 1982 (OIA).
You requested:
Related to the Agricultural Compounds and Veterinary Medicines Amendment
Act 2007.
Please provide all compounds listed by the director General as exempt
under section 8B and section 8C. Please also provide any relevant
conditions or regulations imposed with their use.
And you later refined your request:
Can you please provide the last 12 months for 8C?
There have been no exemptions made under section 8B of the Act; as such,
we have decided to refuse this part of your request pursuant to section
18(g) of the OIA—as the information requested is not held.
We are refusing your request for the details of exemptions made under
section 8C of the Act for research purposes pursuant to section
9(2)(b)(ii) of the OIA—to protect information where the making available
of the information would be likely unreasonably to prejudice the
commercial position of the person who is the subject of the information.
We have decided to grant your request for the compounds and conditions of
approvals for the exemptions made under section 8C of the Act for
non-research purposes where the application was made between 1 June 2022
and 31 May 2023 and approved prior to 20 July 2023. We will provide you
with this information by 11 August 2023.
Some information will be withheld pursuant to the following sections of
the OIA:
o Section 9(2)(a)—to protect the privacy of natural persons.
o Section 9(2)(b)(ii)—to protect information where the making available
of the information would be likely unreasonably to prejudice the
commercial position of the person who is the subject of the
information.
