I refer to your official information request dated 18 July 2023:
In a recent Governance and Administration Select Committee submission, the Mayor
referenced "the minutes of a meeting on Monday 1st May of the three Mayors and three Chief
Executives" (in reference to the Nelson, Tasman and Marlborough Councils). I would like to
request a copy in full of these minutes.
In addition, I would like to request a copy of any meeting minutes or notes of meetings
between two or more of the three Council Mayors this year (2023).
In addition, I would like to request a copy of any correspondence (email or letter) between two
or more of the three Council Mayors this year (2023).
For the purposes of clarity in responding, your request has been broken down into parts as
follows:

At a meeting today of Nelson City, Marlborough and Tasman District Council Mayors and
Chief Executives the following was agreed.
1. There is a desire to take coordinated regional leadership around changes to
Water Infrastructure noting the political uncertainty of an election later this
year.
2. There is an opportunity to transition earlier than the final date of 1 July 2026,
and early engagement with the NTU should occur to commence this discussion.
3. Noting political uncertainty, the group agrees that the positions outlined to the
Minister of Local Government prior to the Affordable Water Infrastructure
announcements remain the shared position i.e. the benefits of a combined
water infrastructure operating model and strong regional representation, the
concerns that dissecting the boundaries of Tasman and Marlborough districts
fails to reflect the communities of interest, the request for the exclusion of
Nelmac in the asset transfer, and the support for iwi participation but not a
legislative requirement for 50% representation. We agreed not to diverge from
this view without discussion amongst the Transition Group outlined below.
4. Approval from each full Council will be sought to establish a Te Tauihu Council
Water Infrastructure Transition Group comprising membership of the three
Mayors and CEOs. We will collectively draft a single resolution to be used for
each council’s separate approval. The purpose of the group will be to work
closely in a coordinated way to lead Water Infrastructure changes for Te Tauihu
5. Early discussions should commence with the NTU who will be invited to the first
meeting of the Te Tauihu Council Water Infrastructure Transition Group (subject
to approval by the three Councils) to examine the opportunities of early
transition.
6. Once guidance from the NTU is received the group wil seek at the earliest
opportunity a hui with iwi to invite a dialogue around iwi participation.
7. Group meetings are expected to be 6 weekly.

guidance on our Councils view. We would welcome further opportunity to engage on this
important issue for our community.

Further to our meeting last week by Zoom of the three Te Tauiho Mayors and
Chief Executives, I have had the opportunity to have a further dialogue with
Nelson City Councillors on the new options being considered of a greater
number of water entities under the Three Waters Reform.
There is a consensus of all elected members in respect of the recent issue that
has arisen over Nelmac, our Council controlled contracting company. The
Transition Unit recently indicated they wished to acquire (without any
compensation) the water services assets and staff of this business. We are
unanimous in our opposition to this and seek at the earliest possible
opportunity this being taken off the table due to the significant uncertainty
and harm this is doing to this trading entity and its staff.
We have previously written jointly with our two neighbouring Councils and
eight Te Tauihu iwi indicating that, if the reform is to proceed and the
Government is insisting on four entities, for us to be included with the rest of
the South Island in proposed Entity D. We are disappointed at your message
that this is not being considered in the reset due to the opposition of Ngai
Tahu.
I must note that a significant number of Nelson City Councillors have lost
confidence in the Government over the three waters reform and did not wish
to express any preference on the question of the number of entities and
alternative configurations. They are concerned that the process is poor and
has become an exercise in trying to resolve a political problem for the
Government in the run up to the election rather than finding the right answer
for the future of three waters management into the future for our community.
These Councillors are particularly aggrieved at the Government developing
the policy on an assurance that it would be voluntary, assuring NZers this
would be the case at the 2020 General Election and then afterwards
significantly changing the policy to making it compulsory for Councils. These
Councillors also believe the Government has misrepresented Council’s
performance in managing water infrastructure particularly as it relates to
Nelson where we are proud of our track record. The taking of $750 million of
water infrastructure assets from our Council (that has associated debt of $70
million) and then providing $20 million in compensation as “Better Off”
funding has also compounded the distrust. They are concerned that in
expressing any view over alternative geographic options that this will be
misinterpreted as support when they are strongly opposed.

A majority of the Council prefer a Te Tauihu Entity over being part of Entity C.
This is due to us having a greater community of interest with Tasman and
Marlborough as compared to Wellington. There is also a view that the
opportunity for Nelson input into a Te Tauihu is significantly greater than a far
larger entity. This view is also influenced by scepticism that the economies of
scale relied upon in the Three Waters economic modelling are not as great as
assumed. One of our 12 Councillors still favours staying as part of Entity C.
It is important to note that this issue of the number and size of entities
addresses only a part of the Nelson City Council’s concerns over the
Government’s proposals on Three Waters. We remain of the view that
stormwater should not be included as it comprises the integrated catchment
management of flood management that unitary Councils like Nelson do well.
We also wish the reforms to recognise these are ratepayer funded assets that
should remain in the ownership of Council and that there needs to be proper
accountability back to elected representatives. We restate our more detailed
concerns provided in our recent submission to the Finance and Expenditure
Select Committee.

Common positions for Mayors of Marlborough, Nelson and Tasman in respect
of Three Waters meeting with Minister, Wednesday 22 March
1. The new water entities need to have more direct accountability to
ratepayers and councils. We favour a model where the elected councils
appoint the directors and have oversight of performance through letters
of expectation and statements of intent as well as half and full-year
financial and non-financial reporting.
2. We support iwi participation on the water entities but not a legislative
requirement for 50% representation. The diversity of iwi across New
Zealand requires flexibility in the way in which their voices are included
in the water entities structure. We favour a model more like that in the
Natural and Built Environment Bill.
3. Nelmac should be treated no differently to privately owned water
services companies. Their inclusion in the asset transfer is unfair to
councils that have retained ownership. Including them will
unnecessarily complicate the role of the new water entities.
4. Water entity boundaries should be determined on the basis of
communities of interest, water catchments and existing water networks
and not subdivide existing territorial authorities. The current proposal
bisects the Tasman and Marlborough districts.
5. If the proposed 4 water-entity model remains, all three councils wish to
be part of South Island Entity D. This position was reinforced in a letter
to Ministers endorsed by the eight Te Tauihu iwi. We would be open to
a greater number of water entities, albeit further work is required on
the optimum number and appropriate boundaries. Any future structure
must ensure equity of costs between entities and financial
sustainability.

Three Waters Reform - Potential Amendments
Thank you f or including Te Tauihu unitary councils, including Marlborough, in last week’s discussion of
potential amendments to the current Three Waters ref orm proposals.
It was made clear in your discussion slides that the Government’s intention is to continue the ref orms but
to also consider changes which might achieve three key priorities:
1.
Strengthen the links between councils and entities;
2.
Ensure that water service entities and councils have f inancial independence to invest in the things
they need to; and
3.
‘No district is lef t behind.’
You also made it clear that several of the common positions the three Te Tauihu Mayors agreed on were
likely to be unacceptable, these being:
1.
Any representation proposals which did not maintain balance sheet separation;
2.
The inclusion of Te Tauihu councils in Entity D.
Your position on these two key aspects of the Te Tauihu position limits the options f or changes to
increasing the number of entities, thus providing the opportunity f or more direct representation on
Regional Representative Committees than we currently have.
Unf ortunately, the projected $2,051 average household cost of a Te Tauihu entity as provided by
DIA of f icials (Attachment 1) becomes $3,150 per annum, signif icantly up f rom the $1,360 modelled f or
Entity C.
Marlborough District Council (MDC) has always accepted the need f or some type of ref orm but
recognises the very challenging magnitude of f uture three waters investment required both to address
current water quality and capacity challenges and particularly the f uture need to invest in climate change
resilience. Our communities, and Māori in particular, have high expectations to greatly enhance ef f luent
and stormwater discharge quality, which will be very expensive. These are massive challenges.
That means a Te Tauihu entity is not supported by MDC on the grounds of af f ordability. If Government
does increase the number of entities, we believe a cost equalisation mechanism across all entities must
be implemented. This was a key element and benef it of the ref orm proposals.
If we are theref ore stuck with Entity C, our issue has always been ensuring Marlborough has a strong
voice in determining the priority capital investments of the new entity. We f ear that Marlborough’s
three waters investment will f all behind and the much larger Wellington City and surrounding urban
councils such as Hutt Valley, Porirua and the Kapiti Coast, with their much greater residential land
demands, will dominate f uture investments. MDC’s submissions to the Water Services Entities and
Water Services Legislation Bills have consistently expressed our concern about loss of local democratic
inf luence and lack of consideration of alternative models which could mitigate that.
Three Waters Reform - Potential Amendments
MDC may not be represented on the Regional Representative Group. The Regional Advisory Panels also
dilute our inf luence because they are Te Tauihu-wide. This is our most signif icant concern and because
of that our community is adamantly opposed to the new system to a large degree.
We suggest that Government could still counter those f ears through strong direction f rom its
Government Policy Statement (GPS) on Three Waters. The GPS needs to insist that all council growth
requirements be given equal weight by the water entities. The entities in turn need to be structured so
that individual councils can have access to entity local and senior management at all times, to be able to
move quickly and f lexibly if local development opportunities arise.
A recent example f or MDC was a proposal f rom a major retirement village company to build a large
village on the periphery of Blenheim’s urban residential area. The village will provide the equivalent of
over 300 houses and so is of signif icant benef it to the region’s housing challenges. The inf rastructure
necessary was problematic being some years away in our Long-Term Plan. There were adjoining private
landowner dif f iculties in providing three waters service access. MDC was able to work with the retirement
village, amend our three waters priorities and get the development underway with some smart
engineering.
To support such local devolvement and input, councils will need ongoing three waters knowledge and
experience within its staf f . Such staf f will need to act as the key liaison people with the entity staf f ,
identif ying community issues, contributing to land use planning, assisting senior council staf f and
councillors to understand entity proposals and ensuring a strong link between the entity and council’s
long term planning. We believe f unding f or this should come f rom either the Government or the
Three Waters entities.
In summary, Marlborough District Council:
1.
Is disappointed that we cannot join Entity D at this point and would like f urther consideration to be
given to this.
2.
Does not f avour a smaller entity across Te Tauihu on af f ordability grounds, unless a cross entity
cost equalisation mechanism is implemented.
3.
If we cannot join Entity D and smaller councils cannot be assured that cost equalisation will be
provided, our next pref erence is to remain in Entity C.
4.
Seeks Government support f or much stronger directives to the new entities to engage regularly and
directly with local councils at both staf f and governance levels
5.
Seeks Government support f or a f lexible and responsive approach to f uture development

At a meeting today of Nelson City, Marlborough and Tasman District Council Mayors and
Chief Executives the following was agreed.
1. There is a desire to take coordinated regional leadership around changes to Water
Infrastructure noting the political uncertainty of an election later this year.
2. There is an opportunity to transition earlier than the final date of 1 July 2026, and
early engagement with the NTU should occur to commence this discussion.
3. Noting political uncertainty, the group agrees that the positions outlined to the
Minister of Local Government prior to the Affordable Water Infrastructure
announcements remain the shared position i.e. the benefits of a combined water
infrastructure operating model and strong regional representation, the concerns
that dissecting the boundaries of Tasman and Marlborough districts fails to reflect
the communities of interest, the request for the exclusion of Nelmac in the asset
transfer, and the support for iwi participation but not a legislative requirement for
50% representation. We agreed not to diverge from this view without discussion
amongst the Transition Group outlined below.
4. Approval from each full Council will be sought to establish a Te Tauihu Council Water
Infrastructure Transition Group comprising membership of the three Mayors and
CEOs. We will collectively draft a single resolution to be used for each council’s
separate approval. The purpose of the group will be to work closely in a coordinated
way to lead Water Infrastructure changes for Te Tauihu
5. Early discussions should commence with the NTU who will be invited to the first
meeting of the Te Tauihu Council Water Infrastructure Transition Group (subject to
approval by the three Councils) to examine the opportunities of early transition.
6. Once guidance from the NTU is received the group will seek at the earliest
opportunity a hui with iwi to invite a dialogue around iwi participation.
7. Group meetings are expected to be 6 weekly.

I did not agree that our letter to Minister McAlnulty propose a membership for the steering
group membership along the lines you have proposed. Quite to the contrary, I stated a
number of times that I did not wish to set any precedent on this quite divisive issue until
after the General Election when Government policy would become more settled. I suggest
replacing the sentence after NTU with “ The purpose of the steering group should be
focused on the operational challenges of establishing a Te Tauihu water entity and we
suggest representation comprising of CEOs and Infrastructure Managers from each Council.
Our Councils are cautious of committing to any particularly model for governance when
there will be significant political uncertainty over this until after the General Election.” The
subtle but important difference is not setting a precedent on representation. The ownership
of the steering group is also then with the NTU not Councils.
I also wish to push for us each doing as we committed in note 4 of your notes from May 1st
- that is formalising our Water Infrastructure Tranistion Group by Council resolution. This
provides an important balance to the steering group. I would be happy for us to note that the
makeup of this transition group will be reviewed after the General Election so as to take into
account the future direction of water policy.
Nigel and I are less enthusiastic about pressing ahead with the NTU work but in the
interests of compromise and moving ahead feel this is a constructive way forward. It
provides the balance of the steering group getting and doing some early work while
delivering on what we agreed early in May.

our two Councils for extensions of the delivery timetables for cycleway
projects in our two regions to enable us to be able to properly consult and
engage with the effected communities on their delivery.
Cycleways are the easiest to build when they are incorporated from the
beginning in new developments. They are a lot more challenging when they
are being added into an existing urban environment. Space within the roading
corridor is often contested and new cycleways can result in the loss of
parking, narrowing of carriageways, changes to property entrances, impacts
on businesses and significant debate on how best to ensure the safety of all
road users. It is possible to overcome these problems of retrofitting cycleways
into an existing roading layout, but it requires thorough engagement with the
community and careful design. The danger with pushing ahead without proper
consultation is that it alienates communities and is counterproductive to
support for providing greater transport choices.
The current timetable for the delivery of cycleway projects in Nelson and
Tasman does not give sufficient time. The insistence that the projects be
completed by June 2024 does not allow sufficient time for preliminary design,
consultation with communities, final design, contract tendering and
construction. We are disappointed that our requests to Waka Kotahi for an
extension to June 2025 has been declined and their advise that we will lose
the funding if the projects are not completed within the year.
A good example of the sort of project at risk is the $4 million East- West
Cycleway in Nelson City. This proposal will significantly add and improve the
network of cycleways in Nelson by providing a dedicated cycleway from the
eastern suburbs to major schools and the hospital as well as then linking to
the main cycleways north and south. However, it is a complicated geography
that will involve at least six roads, hundreds of homes and dozens of
businesses. We would welcome showing the area to understand the
complexity of the project.
Our Councils have both become involved in controversies in recent months
over transport initiatives in places like Pohara, Motueka, Stoke and in the City
over changes in the roading corridor required to deliver Government transport
priorities for cycleways and buses. These issues can be managed with careful
and thorough consultation but not without adequate time. We are also

concerned about the toll on our staff from the backlash when times are
inadequate to do these processes well.
We are sure that you will also be ware that our region is also having to
manage tens of millions of infrastructure repair work arising from the August
storms last year. This work is putting our engineering teams under huge
pressure. The Nelson Annual Plan has us doing more infrastructural work in
2023/24 than ever in NCC’s history and Tasman’s is similarly ambitious.
Nelson’s incoming and new Chief Executive has advised that it is just not
possible or reasonable to deliver these cycleway projects on this timetable as
well as the flood repair work, and that the repair works need to take priority.
I would welcome further engagement with your Transport or Waka Kotahi
