Department of Internal Affairs
Tēnā koe Sue,
I am contacting you today regarding your Official Information Act 1982
request made to the Department of Internal Affairs (the Department) which
has been referred to my team for response.
You have requested:
all analysis, internal advice, and external information including advice
and or analysis to any Minister or Cabinet about compliance and/ or any
possible non-compliance of the restrictions in the Freedom Camping Act
with Freedoms protected by the NZBill of Rights Act and by ICCPR and/ or
with the public interest including safe travel of New Zealanders around
our country and affordable opportunities to explore and enjoy the great
New Zealand outdoors.
We wish to clarify the timeframe of your request. Are you requesting
analysis/advice/information relating to the introduction of the Freedom
Camping Act in 2011, or to amendments made in 2022?
A request for documentation relating to analysis/advice/information given
in 2011 could potentially be refused under section 18(f) of the Official
Information Act, as it would require substantial manual collation.
If you are requesting analysis/advice/information on the 2022 amendments,
would a timeframe of between January 2020 and January 2023 be sufficient?
Ngā mihi,
Milan

Kia Ora Sue,
We refer to your OIA request transferred to MBIE on 31 October 2023, as it
has been leading the Government’s freedom camping reforms in recent years.
We understand you have previously agreed the scope of your request with
the Department of Internal Affairs as follows:
“- information relating to the 2022/2023 amendments, for the time period
of January 2020 - January 2023
- any NZBORA advice in relation to the original Freedom Camping Bill/ Act”
Because of MBIE’s specific involvement/knowledge of the recent reforms we
wanted to discuss the scope of your request. As your request has the
potential to be very large in scale and therefore take us a significant
time to undertake, we are asking for some further information, please.
“Information relating to the 2022/2023 amendments, for the time period of
January 2020 – January 2023”
This part of your request would cover every element of the 2023 amendments
and is likely to cover a significant amount of information, and would
likely significantly impact on MBIE’s response time.
o Would you be able to provide more clarity about the topics you are
interested in? We have provided a range of advice on the costs and
impacts of compliance with the legislation. Would that be a topic you
are seeking documents about?
o What type of documents are you seeking (for example; reports, memos,
emails, other correspondence etc)?
o Which recipients for these documents (for example; Ministers, Select
Committee, officials etc)?
o The key policy stage of the reforms (where MBIE was providing advice)
was between February 2021 (when a public discussion document was
released) and April 2023 (prior to the new Act being passed by
Parliament) – would this be the time period you are interested in?
“Any NZBORA advice in relation to the original Freedom Camping Bill/ Act”
o What type of documents are you seeking (for example; reports, memos,
emails, other correspondence etc)?
o Which recipients for these documents (for example; Ministers, Select
Committee, officials etc)?
o MBIE has been leading the Government’s freedom camping work since 2018
(7 years after the passing of the original Freedom Camping Act). Are
you seeking documents that go back to 2018 or the BORA advice
specifically linked to the development of the new legislation from
2021?
We look forward to receiving your response by the end of this week on 3
November 2023 or sooner if possible, please.
