I am writing regarding the Ministry for the Environment's letter dated 29
October 2024 concerning your Official Information Act 1982 (OIA) request
(Reference OIAD-1327). We refused your request on the grounds that we
expected to publish the requested information by 28 November 2024.
Unfortunately, we have been unable to publish the information within the
anticipated timeframe. Due to the large volume of material involved, and
other unforeseen delays, the Ministry is prioritising the publication of
submissions and substantive correspondence with applicants (e.g.,
clarifications regarding submissions) for the 149 projects approved by
Cabinet for inclusion in Schedule 2 of the Bill.
We now aim to have all submissions, excluding withdrawn submissions,
publicly available on or before 20 December. Additionally, advice provided
to Ministers and the Advisory Group (including Officials’ Summary Papers)
will be published separately on our website by the same date.
Once published, this information will be accessible here:

We want to assure you that the Ministry is working diligently to finalise
and release this information as soon as possible. Information will be

A complaint to the Ombudsman has been filed regarding the release of these documents because Fast Track legislation is likely to be passed before documents are released severely limiting our ability to challenge the inclusion of this project.

Worth noting in a recent case note, the Ombdusman ruled that proactive releases cannot come with redactions; "Unless it is certain that all requested information will be released in full the grounds in section 18(d) are not made out."
