Very disappointing that ACC waited until the last possible hour only to say the information doesn't exist in the exact format requested, but does exist in a slightly different format. Rather than a separate request under the OIA, all that seems to be required here is clarification.
My understanding of the OIA says that ACC should have requested this clarification within 7 working days of the original request, in line with section 15(1AB)(b). If my understanding is correct, then because they did not do this ACC should not be legally entitled to a an additional 20 working days in responding to this request once it has been clarified that the data should be provided in the format they have said is available.
