Discipline for sexual activity
Ti Lamusse made this Official Information request to Department of Corrections
The request was successful.
From: Ti Lamusse
Dear Department of Corrections,
I am interested in the Department's policy for dealing with consensual sexual activity between prisoners.
I was recently told by a prisoner that the Department's policy was that if two or more prisoners were caught engaging in sexual activities, the prisoners would be separated and sent to different units.
(1) Is this the Department's policy in response to discovering consensual sexual activity between adult prisoners?
(2) What is the Department of Corrections' policy to deal with consensual sexual activity between adult prisoners?
(3) Can prisoners face disciplinary action for engaging in consensual sexual activity with another adult prisoner?
(4) How many prisoners have had internal charges of inappropriate conduct laid against them since February 2007?
(a) Please break this down by year.
(b) Please break this down by prison.
(5) What does the Department of Corrections define as inappropriate conduct, for which a prisoner can be charged?
(6) How many prisoners have had internal charges of inappropriate sexual conduct laid against them since February 2007 (excluding sexual assault)?
(a) Please break this down by year.
(b) Please break this down by prison.
(6) How many prisoners have had internal charges of inappropriate sexual conduct with another prisoner laid against since February 2007 (excluding sexual assault)?
(a) Please break this down by year.
(b) Please break this down by prison.
(7) When a Corrections staff member finds two or more adult prisoners engaging in consensual sexual activity, what is the expected response from that staff member?
(8) When a Corrections staff member finds two or more adult prisoners engaging in consensual unprotected sexual activity, is that staff member expected to inform the prisoners about access to condoms?
Yours faithfully,
Ti Lamusse

Dear Vincent,
Thank you for your reply.
Please be aware that you did not answer questions 8 and 9. I will repeat them again for you here:
"(7) When a Corrections staff member finds two or more adult prisoners engaging in consensual sexual activity, what is the expected response from that staff member?
(8) When a Corrections staff member finds two or more adult prisoners engaging in consensual unprotected sexual activity, is that staff member expected to inform the prisoners about access to condoms?"
In the response, you provided me with a brief explanation of the availability of prophylactics, criteria for double bunking, and information about non-consensual sexual behaviour.
I specifically asked about the expected response of staff members who discovered two or more adult prisoners engaging in consensual sexual activities. You did not answer these requests for information. Please answer the above questions.
I ask a clarifying question in addition to my original questions: is there any expected response from a Department of Corrections staff member who discovers two or more prisoners engaging in consensual sexual activity?
As always, I look forward to your forthcoming response.
Yours sincerely,
Ti Lamusse
