Dear Mr Ross,
Thank you for your 4 August 2017 request to the Electoral Commission under
the Official Information Act 1982 (the Act).
You have requested:
‘a copy of the candidate donations and expenses return form for Metiria
Turei from the following General Elections
A) The 1993 General Election as a candidate for the McGillicuddy Serious
Party, &
B) The 1996 General Election as a candidate for the Aotearoa Legalise
Cannabis Party’.
The documents you request cannot be made available because the documents
are no longer held.
The law that applied to the 1993 and 1996 elections provided that the
Chief Electoral Officer must keep and make available for inspection
candidate returns for the period from the date of receipt until the close
of polling day for the second general election after the return was
received. At the expiration of that period, the legislation required that
the returns be destroyed.
For this reason candidate returns for the 1993 and 1996 general elections
are not available.
You have the right under section 28(3) of the Act to complain to the
Ombudsman if you are not satisfied with the response to your request.
Kind regards
Kristina Temel
