Dear Niki Wright,

Thank you for your reply and your advice that my OIA request has been refused under section 18(d).

However, section 18(d) relates to information publicly available or information in Draft that will be publicily available soon.

Neither of these situation apply at the time my request was made, the Standard Operating Procedures have been in effect since 1 November 2001.

I would add, HDC have provided requests made via FYI previously without issue.

A complaint to the Ombudsman would have to consider your refusal and whether the decision was justified.

As the document is not pubicly available or in Draft, HDC have meet others requests on FYI, then it is logical that HDC’s refusal woukd be in the circumstances unreasonable as per section 30(1)(b).

With respect I would therefore ask you to revisit your decision and provide the requested information.

It is some what concerning a commission that is there to protect consumer rights is itself breaching the OIA act, which core intention is to provide the public trust in gov thru transparency.

The stance taken by HDC is in conflict of consumer rights.

Dear Health and Disability Commissioner,

This request is now exceeding 50 plus days.

Iam sure the ombudsman has enough cases on his hands and doesnt need another case to resolve.

So please explain why the HDC disregard the provisions of the Offical Information Act, including the grounds in which you have denied to provide the Information. as you state its available on the HDC webpage, yet it still has not heen uploaded.

I was very surprised to see that the HDC are now charging for alot of the information they provide from the webpage, this is completely the oposite to SSC, OPC, Ombudsman or the Ministers themselves. This would appear to be unhelpful in providing the piblic with resources for which they have ultimatley paid via income tax etc.
