FNDC Dog Shelters Statistics from February 2019 to June 2019

Dear Far North District Council,

Please supply the following information under the (Official Information ACT (OIA) /Local Government Official Information and Meeting ACT (LGOIMA)

I am requesting the following statistical information regarding dogs impounded at the Northern Shelter, Kaitaia and Southern Temporary Shelter, Horeke.

Horeke Dog Shelter

For all dogs impounded within the months of February 2019, March 2019, April 2019, May 2019 and June 2019 the following figures:

1. Total Dogs impounded for each month
2. Number of impounded Dogs Euthanised for each month
3. Number of Impounded Dogs that died while impounded for each month
4. Number of Impounded Dogs returned to owner for each month
5. Number of Impounded Dogs rehomed by FNDC and not taken by a rescue/Agency group or SPCA for each month
6. Number of Impounded Dogs welfare compromised and sent to the SPCA for each month
7. Number of Impounded Dogs rehomed to each agency including Agency/Rescue name for each month
8. The number of dogs surrendered by the owner (not including SPCA surrendered/transferred/given) to FNDC for each month
9. The number of dogs surrendered/transferred/given by SPCA to FNDC dog shelters for each month

Kaitaia Dog Shelter

For all dogs impounded within the months of February 2019, March 2019, April 2019, May 2019 and June 2019 the following figures:

1. Total Dogs impounded for each month

4. Number of Impounded Dogs returned to owner for each month

Official information request: 3957796 – statistics on impounded dogs

 

I refer to your information request received 14 June  2019, which has been
referred to Legal Services for consideration in accordance with the
provisions of the Local Government Official Information and Meetings Act
1987 (“the LGOIMA”).

 

Information request

 

You requested the following statistical information regarding dogs
impounded within the months of February 2019, March 2019, April 2019, May
2019 and June 2019 - in respect of both the Northern (Kaitaia), and the
Southern Temporary (Horeke) Shelters:

 

“For all dogs impounded the following figures:

1.      Total Dogs impounded for each month

2.      Number of impounded Dogs Euthanised for each month

3.      Number of Impounded Dogs that died while impounded for each month

4.      Number of Impounded Dogs returned to owner for each month

5.      Number of Impounded Dogs rehomed by FNDC and not taken by a
rescue/Agency group or SPCA for each month

6.      Number of Impounded Dogs welfare compromised and sent to the SPCA
for each month

7.      Number of Impounded Dogs rehomed to each agency including

Council response

 

The Far North District Council (the “Council’) has decided to release the
information to you, however it considers that this LGOIMA request is a
significant exercise. The statistical data you have requested will take
some time to locate, collate and prepare the information for disclosure
etc.

 

For Council to be satisfied that it will be providing you with full and
accurate information, we have considered whether charging for the supply
of information pursuant to section 13(1A) of the LGOIMA would be
reasonable and appropriate in this case.

 

With any proposed charge, regard may be had to the cost of labour and
materials involved in making the information available (i.e. the staff
time required to prepare information for release, photocopying charges and
other fixed costs incurred in preparing the information for release).
Council’s Fees and Charges Schedule (which is in keeping with the Ministry
of Justice guidelines), imposes a charge for the supply of Official
Information at $38.00 per half hour (incl. GST) with the first hour being
free. Photocopying charges are applicable if photocopying is required. I

An estimate of 4 hours of staff time will be required to process your
request. In accordance with our fees and charges this equates to an
estimated charge of $228.00   (4 hours at $76.00 per hour, first hour
free). In deciding this, the Council has considered whether any reduction
or waiver of the proposed charge may be warranted having regard to both
your circumstances and the public interest in release of the information.
It has concluded that it is not. We would endeavour to provide you with
the information by email however if photocopying is required, this will be
provided at 20 cents per page plus postage.

 

In line with Ombudsman guidance, you are invited to refine the scope of
your request and thereby reduce the charge to be imposed. Should you wish
to do so, please let me know.

 

However, if you are happy to pay the charge, in accordance with section
13(4) of the LGOIMA, we will require payment before provision of
information; so please advise as such.

 

Once we receive a reply from you, we will respond as soon as reasonably
practicable.

 

You have the right to seek a review by the Ombudsman of this decision.

Dear Erica Cooney,

I thank you for your reply to this LGOMIA request.

I am a little shocked that you have asked for payment for this request considering in the past my request for impounding figures have been supplied free of charge as the bulk of the data comes from the council impounding database and supplied in a spreadsheet. I'll refer to history of past "request for service", 3873580 (28 February 2018), 3917484 (33 October 2018) and 3936725 (19 February 2019) which Far district has supplied without issue.

If this is no longer the case should you please clarify the change in stance by council on supplying this request.

As stated below, under the LGOIMA (the 'Act'), Council is entitled to charge as it considers appropriate. Please refer to Section 13 of the Act. The Office of the Ombudsman also provides a Guide.
If you have any queries you can refer these to the Ombudsman; or as you likely know and as noted below - you have the right to seek a review by the Ombudsman of Council's decision.

This request has been forwarded to Ombudsman as FNDC didn't supply clarification on why charge for the request as in the past this was given freely.

$76 an hour for a junior to gather information that should be easily available. Reasonable charges should not include a hefty profit.
