referred to Legal Services for consideration in accordance with the
provisions of the Local Government Official Information and Meetings Act
1987 (“the LGOIMA”).

 

Your request

 

You noted “There are two CCTV cameras attached to a light standard on the
corner of Aucks Road and the Russell-Whakapara Road.

This road is maintained by the Far North District Council, as will be the

You asked:

“When was permission given by the District Council for these two cameras,

Council response

 

The information you requested does not exist. Investigations show that no
application for permission to install these CCTV cameras has been made to
the Far North District Council (the ‘Council’).  Given this, we must
refuse your request under section 17(e) of the LGOIMA. This provision
states:

Section 17 Refusal of requests

“A request […] may be refused only for 1 or more of the following reasons,
namely:

[…]

(e) that the document alleged to contain the information requested does
not exist […] “

The content of the recalled response leads me to add a further question about these CCTV cameras: If the Council has not granted permissionfor the cameras to be placed on the light standard, what action is being undertaken by the Council to get the cameras removed.

My apologies for the mix-up in trying to recall the response with the
subject line called 'draft response'. My recall ‘effort’ was because I
initially accidentally sent the response headed 'draft', rather than the
one headed 'final' response; however it sounds like I inadvertently
recalled both. So I’m sorry, the reply without 'draft' in the subject line
is Council's response to your LGOIMA query, and I hope you are not left
confused.

 

In relation to your new question, thank you for having notified Council
about these two CCTV cameras having been installed on the streetlight post
within the road corridor. As a result of your query, Council is now
investigating the issue. Once it has obtained all of the relevant
information,  it will be in a position to decide what is the appropriate
action to take, and will then advise you of the outcome in the matter.

Council’s response

The Council responded to your LGOIMA request on 5 July 2019. On 8 July,
Council received a further question from you, namely “If the Council has
not granted permission for the cameras to be placed on the light standard,
what action is being undertaken by the Council to get the cameras
removed.”

The Council has decided that regrettably it requires an extension to fully
and properly respond to your query. While the LGOIMA requires that we
advise you of our decision on your request no later than 20 working days
after the day we received your request, unfortunately it will not be
possible in this case to meet that time limit to respond to your
additional question. We are therefore writing to notify you of the
extension of the time to make our decision, to Friday 30 August 2019.

 

This extension is necessary because one of the key people with an interest
in the CCTV camera situation has advised that he is currently overseas for
a number of weeks. Council will not be able to be properly informed and
make an appropriate decision on the future of the CCTV cameras until it
has consulted appropriately, and received all the pertinent information it
is seeking.

 

You have the right to seek a review by the Ombudsman of this decision.

Council’s response

The Council responded to your original LGOIMA request on 5 July 2019,
stating that the information requested did not exist. Investigations had
showed that no application for permission to install these CCTV cameras
had been made to the Far North District Council (the Council’). 
Therefore, your request was refused under section 17(e) of the LGOIMA.

 

Further request

On 8 July, Council received a further question from you, namely “If the
Council has not granted permission for the cameras to be placed on the
light standard, what action is being undertaken by the Council to get the
cameras removed.”

 

Council’s response to further request

On 19 July 2019, Council advised that it required an extension of time to
meaningfully respond to this additional query. This extension was seen as
necessary given that one of the key people with an interest in the matter
had advised Council he would be overseas for some weeks, but wished to
discuss the cameras remaining attached to the pole on his return.

 

In the interim, Council sought information from various technical experts
about the matter. Based on the advice provided to Council, it has sought
the removal of these CCTV cameras, with this to be completed by 19 August
2019.

 

Again, the Council wishes to acknowledge its appreciation that you alerted
it to the presence of these cameras attached to Council property.
