Background;
I refer to an official information request lodged with the Corporation via www.fyi.org.nz on August 26, 2019 titled Partnered Recovery Unit - Wellington which can be found at the following web link https://fyi.org.nz/request/11058-partner....
In addition, I refer you official information that was released by the Corporation's then Senior Advisor of Government Services, Gabby Boag, to Mr M Gibson on the 4 August 2009 in response to Mr Gibson's official information request of 5 June 2009.
The official information Gabby Boag released to Mr Gibson on the 4 August 2009 on behalf of the Corporation consisted of the following;
a) A two page cover letter dated 4 August 2009 signed on behalf of the Corporation by Gabby Boag.
b) The ACC Executive Leadership Teams Issues Paper dated 16 February 2009 which was presented to ACC's Executive Leadership Team. This paper is now commonly referred to as the "Riley Report". The Report was from Phil Riley the then ACC Long-term Claims Project Lead and was channeled via Denise Cosgrove, General Manager, People & Business Services.
The documented subject of the ACC Executive Leadership Teams Issues Paper referred to above was as read and now quoted " Strategy for the Future Management of Long-terms Claims. The Status of the ACC Executive Leadership Teams Issues Paper was marked requiring a decision from the ACC Executive Leadership Team to;
a) endorse the proposed strategy for the management of long-term claim,
b) approve additional staffing and funding to set up and form the ACC Recover Independence Service (commonly refer to as the RIS) case management stream. The RIS
c) seek back dated approval from the ACC Executive Leadership Team to have endorsed a series of actions incorporating transitional services alonf the lines to form the RIS concept that the ACC Long Term Claims Project had already implemented without first having received the ACC's Executive Leadership Team's prior approval.
Official Information Requests;
Context: with ACC forming a new unit called the "Partnered Recovery Unit - Wellington" I am seeking the release under the OIA 1982 of the following official information.
OIA Request 1.
Please advise which team, project team or division within ACC developed the business case and business model for the formation of the Partnered Recovery Unit....Please provide the formal title of the team or division, together with the name of the person whom ultimately lead this initiative.
OIA Request 2.
Please make available to me copies of all research and information that the ACC team/unit in OIA Request 1. above and the lead person responsible for the formation of the Partnered Recovery Unit referenced , used and created to put a business case, and business model and reasoning advanced forward within ACC seeking the approval of the formation of the Partnered Recovery Unit.
OIA Request 3.
Please advise the formal title of the team, project team or business unit within ACC, to which the team, project team or division named in your OIA response to OIA Request 1, advanced their business case seeking the necessary approval for the formation of the Partnered Recovery Unit within ACC.
OIA Request 4.
Please supply me full copies of all the original documentation (i.e. the modern day ACC equivalent of the Executive Leadership Team Issues Paper that Phil Riley advanced via Denise Cosgrove on 16 February 2009 to the Executive Leadership Team within ACC to have approved the RIS team), for which the team, project team or division within ACC that developed the business case and business model for the formation of the Partnered Recovery Unit pending to be named by the corporation in response to my OIA Request 1 above, advanced to the team, project team or division I have requested to be named in my OIA Request 3 within ACC to, for endorsement and approval/sign-off for the formation of the Partnered Recovery Unit.
OIA Request 5
Please confirm by way of written statement that the Partnered Recovery Unit is based in Wellington.
OIA Request 6
Please confirm by way of written statement if there are any other Partnered Recovery Unit's based at different locations around New Zealand and if so pllease advise which locations.
OIA Request 7.
I thank you for your assistance and respectfully request that under s16(2) of the Official Information Act, my preferred way of receiving a response is by email to the address from which ACC received the original request, not by post.
OIA Request 8
Please confirm by way of written statement all parties, entities, organisations, external or internal to ACC that are associated with the Partnered Recovery Unit.
OIA Request 9
Please arrange for the provision of full copies of the master ACC service contract, and any deviation based on partner type, that ACC has entered into with all parties, entities, organisations, external or internal to ACC that are associated with the Partnered Recovery Unit.
OIA Request 10.
Please confirm by way of written statement as to whether ACC is projected to achieve an actuarial release in liability (cost savings in layman's terms) through the formation of the Partnered Recovery Unit....if so please provide copies of the effect on ACC's liabilities as for the periods forecast in ACC's business modeling.
OIA Request 11.
In the event that the Partnered Recovery Unit has been formed to save the Corporation in terms of actuarial release in liability please clearly identify which services to the ACC claimant targeted for placement within the Partnered Recovery Unit will be ceased, or amended in order to achieve ACC's actuarial release in liability, and provide copies of the research undertaken by ACC in line with their duty of care to establish whether the changes to the targeted claimants previous services will impact upon them in a negative or positive manner.
OIA Request 12.
Please confirm by way of written statement as to whether ACC is projected to achieve an actuarial gain in liability (additional costs to the Corporation in layman's terms) through the formation of the Partnered Recovery Unit....if so please provide copies of the effect on ACC's liabilities as for the periods forecast in ACC's business modeling.
OIA Request 13.
In the event that the Partnered Recovery Unit has been formed at an additional actuarial
cost in Liability to the Corporation please clearly identify which services to the ACC claimant targeted for placement within the Partnered Recovery Unit will be added to or enhanced order to achieve ACC's objectives of the Partnered Recovery Unit, and provide copies of the research undertaken to establish that ACC has discharged their duty of care to the targeted claimants in having researched and documented ACC's estimated impact upon ACC claimants placed in the Partnered Recovery Unit and whether these impacts are negative or positive manner.
OIA Request 14
Please provide full copies of all original documentation and official information that guides the ACC staff members, and any Partner members external to ACC incorporated within the Partnered Recovery Unit that specifies the manner and instructions for the Partner Recovery Unit's responsibilities with case managing clients whom have been targeted for placement within the Partnered Recovery Unit, highlighting in your response every and all situation as to where a claimant in the Partnered Recovery Unit's rights as opposed to a general claimant on an IRP weekly compensation plan managed by a local branch has been restricted (i.e. communication plans, etc and the like, but solely not limited to this) in any way shape of form.
OIA Request 15
If external agents/entities and organisations have been included within the Partnered Recovery Unit business model.....please provide a written statement that confirms that such entities will be;
1. subject to full compliance with the ACC Code of claimants rights,
2. subject to complaince with the Official Information Act,
3. and that the claimants rights of review and appeal under the ACC Act will not be compromised in any way, manner, shape or form.
OIA Request 16
Please provide a written statement confirming what stakeholder groups internal and external to ACC were consulted about the formation of the Partnered Recovery Unit, and provide copies of all original feedback and submissions provided by these stakeholders.
