Trusted Regulator approach - Consultation August 2019
J Bruning made this Official Information request to Ministry for the Environment
Response to this request is long overdue. By law Ministry for the Environment should have responded by now (details and exceptions). The requester can complain to the Ombudsman.
From: J Bruning
Dear Ministry for the Environment,
Please consider this an Official Information Act request.
Re: Hazardous substances assessments: Improving decision-making – A discussion document on proposed improvements to assessments and reassessments of hazardous substances - Consultation August 2019.
https://www.mfe.govt.nz/sites/default/fi...
Please make publicly available the content of all submissions responding to the August 2019 discussion document.
The results of this consultation have not been published -
https://www.mfe.govt.nz/consultations/ha...
I expect personal numbers and emails from citizens submitting in a personal capacity to be redacted, but not from persons submitting in a professional capacity. This includes agencies, academics, companies, including members and associates of lobbying organisations who lobby on behalf of commercial interests.
Thank you
Yours faithfully,
J. Bruning.

Dear J. Bruning,
Thank you for your request of 25 May for official information.
Please confirm whether, by “the content of all submissions responding to
the August 2019 discussion document” you would like a summary of the
results, or the full text of the original submissions?
The summary is due to be published on the Ministry’s website in the next
six weeks, so the information will soon be publicly available. If you
require the submissions in full we will need to consult the other agencies
involved and an extension to the timeframe would likely be needed.
Ngā mihi,
Dave Edwards - Executive Relations Advisor

Dear Ministerials,
I do not consider an extension for the consultation is justified in these circumstances. Please can you release the submission as soon as reasonably practicable.
As can be seen from the original Discussion Document (p.39-40 Section 4.5) all submitters have been notified that written submissions could be publicly printed. With this knowledge, submitters to the process should expect to have their submissions released if someone requested them. Therefore there is no requirement to consult anyone:
'All or part of any written submission (including names of submitters) may be published on the Ministry for the Environment’s website, www.mfe.govt.nz. Unless you clearly specify otherwise in your submission, the Ministry will consider that you have agreed to have your submission and your name posted on its website.'

Thank you
Yours sincerely,
J Bruning

Dear Ministerials,
The June 17 letter above mentioned that these submissions would be published next month.
I have looked on https://www.mfe.govt.nz/consultations/ha... and cannot clearly see the submissions that you stated would be available in July.
Please confirm the date all submissions be made available in July.
Yours sincerely,
J Bruning
