request you made on 13/10/2020 regarding the St Heliers Safety Upgrade. 

As your request is for information that is not available straight away, we
need to treat it as an official information request. This means that we
follow the rules of the Local Government Official Information and Meetings
Act 1987 (LGOIMA)

Update
Auckland Transport can provide you with the requested information but we
first require a refinement to your request. The refinement is necessary as
the requested information is very broad and spans over a 2yr period.
Auckland Transports allows for 5hrs of LGOIMA work, free of charge, and
collating the data will take longer then 5hrs of work.

If possible, I would like to avoid any charges.
If you could you please give us some details as to why you need the data.
This will help us determine what is relevant and what can be left out.

If I have not heard back from you, I will follow up again on the 16
November.

Dear AT Official Information (AT),

I, and a large number of Aucklanders, do not believe that AT has followed current best practice for the proposed St Heliers Safety Upgrade. It appears that AT has not even followed its own internal guidelines and design rules, or indeed NZTA design rules. I need to see any dispensations from the use of these rules.

I believe that conforming works will mean that this area will need to be reworked after only a few tears as it will need to be upgraded to meet design best practice and to be incorporated into the Tamaki Shared Path now being constructed.

I believe that intensive lobbying from residents and businesses has watered down that design from any proposals developed internally or from consultants reports. I need to see the original design documents and/or consultants reports and how this has changed following these "consultations", ie including red line drawings.

We also need to see correspondence with lobbyists to understand how these modifications were made.

We also need to understand why other stakeholders (eg disabled, youth, and cyclist organisations) were not consulted.

Please provide your response with this priority:
1. Consultant reports.
2. Design proposals (plans and reports)
3. Marked up design documentation (red lines).
4. Signed off dispensations to AT and other design guidelines and rules.
5. Minutes of meetings and emails with 3rd parties (eg lobbyists)

Request to Auckland Transport for information related to St Heliers safety
I am writing on behalf of Chief Ombudsman Peter Boshier.
On 15 March 2021, you made a complaint about Auckland Transport’s (AT) response to your
request for information. Mr Boshier is investigating your complaint.
Your complaint
On 13 October 2020, you made a request to Auckland Transport (AT) for:
… design documents for the proposed safety upgrade, including:

Design proposals (plans and reports)
Marked up design documentation (red lines) showing changes proposed to the initial

Minutes of meetings and emails with interested 3rd parties (including - but not limited
to - Residents Association, youth representatives, and representatives from the
disability community or road safety advocates)
Minutes of meetings and emails within AT and Auckland Council including with board
members and Councillors, regarding this project.
On 20 October 2020, you added “signed copies of all dispensations to depart from AT design rules
and guidelines,” to your request.
There was ongoing dialogue between you and AT that can be located here via fyi.org.nz.
Responses to your request were sent on 18 December 2020, and 2 March 2021.
On 2 March 2021, you advised AT that you believed parts of your request were still outstanding.
While AT attempted to respond to you with links to publically available information, it ultimately
closed your request relying on section 17(d) of the Local Government Official Information and

You are dissatisfied with the response to your request. You believe that there is information
within the scope of your request that remains outstanding, including draft documents with mark
ups. You have complained that the response to your request was inadequate.
The investigation
I have today written to the Chief Executive of AT to commence the investigation. I have asked for
further information about its response to your request.

Appendix 1. An Ombudsman’s role
An Ombudsman may investigate and review any decision by a local government agency on a
request for official information.
Official information must be made available unless there are grounds under the Local
Government Official Information and Meetings Act (LGOIMA) to refuse a request.
After investigating, the Ombudsman forms an opinion whether:
the request should have been refused under the grounds in the LGOIMA; or
the decision was unreasonable or wrong.
The Ombudsman does not act as an advocate for either the complainant or the agency. The
Ombudsman will form an independent opinion on the merits of the complaint.
The investigation process
The Ombudsman’s first step is to notify the Chief Executive of the agency that an investigation has
been commenced. The Ombudsman will seek the relevant information and the reasons for the
decision.
The complaint may be resolved during the course of the investigation—for example by the agency
offering to release information. If so, the Ombudsman may discontinue the investigation.
If the matter is not resolved, the Ombudsman will provide any party adversely affected an
opportunity to comment before forming a final opinion. Once a final opinion is formed, the
Ombudsman can make any recommendations he or she thinks fit. A public duty to observe any
recommendations made by an Ombudsman is imposed on the agency from the 21 st working day
after those recommendations are made.
If the Ombudsman decides to publish details of the matter, the parties would be advised.
Confidentiality
Ombudsmen must conduct their investigations in private,1 and are required to maintain secrecy in
respect of all matters that come to their knowledge. This is subject only to specific exceptions,
one of which relates to explaining to parties the outcome of an investigation.
Because of this, we ask that you maintain the confidentiality of the Ombudsman’s
correspondence to you, until the outcome of this investigation is finalised. This does not prevent
you from seeking legal advice or support on your complaint.

Hi David,

I want to confirm that Auckland Transport is not purposely withholding any information. Information on the St Heliers upgrade has been made publicly available and AT will continue to add more information to our website; https://at.govt.nz/projects-roadworks/vi...

From my understanding, this has been worked on as part of a workgroup. Due to the nature of workgroups, plans are discussed live with a lot of the changes captured in the meeting minutes.

I have spoken to our Business unit and they have managed to find a few draft sketches of plans.
It is important to note that these drafts sketches only convey the reviewers thoughts, at that time, and are similarly to the online markups.
