To enable a response to your request, the council would appreciate
clarification of what you mean by the following statement:
2. Has the council received any objection for removing the statue? If yes,
please provide the details.
The Council is able to collate the number of complaints received via the
call centre and objections received through our social media platforms and
private messages.
Is that what you require?
If you want deeper detail then this, it will be very difficult to meet
without substantial collation or research. This includes the data
extraction and collation of individual complaints, and the redaction of
these to protect the privacy of individuals.
Unless your request is amended, we may have to refuse that part of your
request it under section 17(f) of the LGOIMA, which applies where the
information cannot be made available without substantial collation or
research.
Please let me know before 6 November 2020 whether you are prepared to
amend or clarify your request and, if so, how. Ideally, this would be
restricting the scope of the requested information to the number of
complaints, not the compilation of individual complaints.
Please note, if you do amend or clarify your request, this will be
considered to be a new request for the purpose of calculating the maximum
statutory timeframe for response—see section 13(7) of the LGOIMA. The
Council will, however, respond as soon as practicable.
Regards,

I refer to your information request of 28 October 2020 as attached /
below, Hamilton City Council is able to provide a response.
You requested:
I would like to request the following information regarding the removal of
Hamilton statue, Garden Place.
1. Who will pay the cost of the removal? what's the cost of the removal
2. Has the council received any objection for removing the statue? If yes,
please provide the details
3. What is the current status of the statue?
4. Does the council has any plan to remove other historial statues in the
city?
The Council’s Decision and Response:
Hamilton City Council has paid for the removal of the statue. The cost of
removal was $3,000.
The statue is currently off public display in a secure storage facility.
Council has no plans to remove any other statues.
Hamilton City Council has received objections to the removal of the
statue. These objections have included approximately 38 emails, 31 by
phone, four in person, and a further 21 by Facebook Messenger.
A breakdown of the figures is provided below.
Means of feedback In support of Against removal Other

As per my attached email dated 31 October 2020, the Council is unable to
provide a deeper analysis of the type of feedback without significant
substantial collation and research that would have unduly impacted its
other operations. Detailed analysis of the complaints/objections is
therefore refused, in accordance with the LGOIMA 17(f).
In making the above decision, the Council considered the public interest
in this matter and determined it did not outweigh the undue impact the
collation would have had on its operations.
You have the right to seek an investigation and review by the Ombudsman of
this decision. Information about how to make a complaint is available at
[1]www.ombudsman.parliament.nz or freephone 0800 802 602.
