Dear Department of the Prime Minister and Cabinet,
With respect to the Whakaari/White Island disaster response NEMA (DPMC) have previously advised that they were the Lead Agency at the National level and that Bay of Plenty CD&EM Group were the Lead Agency at the Local level (in accordance with the National CD Emergency Plan Order 2015).
A Lead Agency is responsible for appointing its Controller to manage its response. In this disaster then there would have been a National Controller (NEMA) and a Regional Controller (Bay of Plenty CD&EM Group).
The National Plan also states that responses to emergencies will be based on the NZ Coordinated Incident Management System (CIMS) framework (ref Clause 115).
CIMS (Version 3) further states that “Only one Controller can be the Lead Controller who directs the overall response to the incident (ref Clause 4.4.2).
Under the provisions of the Official Information Act I request the following information with respect to the Whakaari/White Island response:
1. The organisational structure as established by NEMA in accordance with the CIMS model for their role as Lead Agency for the national response. This should include each of the liaison representatives of the responding agencies as specified in the National Plan (ref Clause 124).
2. The daily Incident Action Plans (IAPs) as prepared by the national Incident Management Team (IMT) and signed off by the National Controller in accordance with the CIMS framework. These IAPs should identify the daily Mission, Objectives, Strategy and Tasks for the national response, ie what was the role and responsibilities of NEMA as the national Lead Agency.
3. Confirm that each agency who responded to Whakaari operated in accordance with the direction of the National Controller and provide copies of the reports from each (refer the requirements of Clause 15 of the National Plan).
4. What were the roles and responsibilities with respect to the response that NEMA (as National Lead Agency) delegated to or were otherwise assigned to the Bay of Plenty CD&EM Group (as Regional Lead Agency) under NEMA's lead.
5. Confirmation as to the agency or agencies whose representative was the “single Controller” responsible for the overall response (including the rescue and recovery operations) in accordance with the CIMS framework (Version 3).

As we did not receive the request from FYI until today 15 January 2021, we
will consider today the first working day under the Act. We will provide a
response in accordance with the Act in due course and will endeavour to
process as quickly as possible. Please note that under the Act, the
working days to respond to requests do not include 25 December through to
15 January, to account for the summer break. (please see the Office of

DPMC may publish the response to your Official Information Act request.
When you are provided with a response to this request, you will be
informed about whether the response to your OIA request will be published.

Re your advice that yuo are considering January 15th as the day you received my OIA Request I wish to point out to you (for the record) that this request was sent to you on Dec 18th. The FYI site administrator has advised me that our system received and acknowledged it had received the notice from the FYI system. What ever the problems were that resulted in the delay were caused by your system and for the record, DPMC received my OIA on 18th Dec. I understand there were other FYI messages similarly effected by your system failure.
In this instance it will make only a few days difference but I still consider that you are required by law to consider 18 Dec as the received date. I am not responsible for your faulty system that failed to deliver your received email.
