Thank you for your email of 22 September 2021 to the Minister of Police, Hon Poto Williams, under the Official Information Act 1982 (OIA), the following information:

"Please provide me with all advice and communications to the Minister about the Police’s Tactical Response Model."

The Official Information Act requires that we advise you of our decision on your request no later than 20 working days after the day we received your request. Unfortunately, it will not be possible to meet that time limit and we are therefore writing to notify you that we are extending this request by 30 working days under section 15A(1)(b), of the OIA of an extension of the time to make our decision, to 17 November 2021.

An extension is required to enable necessary consultation on the response.

You have the right to seek an investigation and review by the Ombudsman of this decision. Information about how to make a complaint is available at www.ombudsman.parliament.nz or freephone 0800 802 602.

It's been over two weeks now. When is the Minister going to release these documents as promised?

The Ombudsman's guidance on section 18(d) refusals like this says:

"As a matter of good practice, agencies should provide the precise or approximate date by which the information will be published. A failure to do so may suggest that there is no reasonable certainty that the information will be published in the near future."

I suggest you might want to follow up with the Minister and ask her on what date she had decided these documents will be publicly released. Saying only "in the coming weeks" is very vague.

For a s18(d) refusal to be justified, this decision to release this information publicly should have been made prior to your request having been received. So this information regarding when they are planned to be released should have been known to the Minister for over two months now.

Given the decision to your request was delayed under s15(1)(b) of the OIA, I rather suspect that the decision to release this information publicly was made after the Minister received your request. In which case, I recommend you lay a complaint with the Office of the Ombudsman.

Come to think of it, if the Minister had already decided by 22 September to release these documents publicly at some point in late November or early December, that really does make an absolute farce of the 20 working day consultation period on the Tactical Response Model that kicked off on 22 September doesn't it?
