Kia ora KiwiRail,
I reside in a property that is contiguous with train tracks operated by KiwiRail. Maintenance workers are routinely instructed to complete work on the train tracks from hours spanning between 11 pm and 4 am. This maintenance work clearly breaches the noise restrictions that apply to everyone else, and impacts the sleep of those in the area.
I therefore request information concerning whether KiwiRail has statutory or regulatory authority to breach noise restrictions for maintenance work.

I'd like to acknowledge receipt of your official information request dated 30 September 2021, for information on KiwiRail's authority for breaching noise restrictions.
We received your request on 30 September 2021, and will endeavour to respond to your request as soon as possible and in any event no later than 29 October 2021, i.e. the 20 working days after the day your request was received.
If we are unable to respond to your request by then, we will notify you of an extension of that timeframe.
In addition, if you are able to contact me directly @ [email address] with your location, I will pass on your concerns over the noise at night, so we can better inform you over any work planned for your area.
