Prosecutor numbers
I Brown made this Official Information request to Ministry of Justice
The request was successful.
From: I Brown
Dear Ministry of Justice,
Please provide the following information:
1. The number of lawyers classified as junior prosecutor by Crown Law as at 1 July for the years 2017-2020
2. The number of lawyers classified as intermediate prosecutor by Crown Law as at 1 July for the years 2017-2020.
3. The number of lawyers classified as senior prosecutor by Crown Law as at 1 July for the years 2017-2020.
4. The number of lawyers classified as principal prosecutor by Crown Law as at 1 July for the years 2017-2020.
5. Please provide the above information in two ways:
a) The numbers at each level for the whole of New Zealand; and
b) The numbers at each level working in each court cluster as defined by Legal Aid.
For the avoidance of doubt, the above is not intended to include any lawyers employed by the New Zealand Police Prosecution Service. Nor is it intended to include lawyers on a Crown Panel but who are not employed as prosecutors by a Crown Solicitor's office or a government department.
Yours faithfully,
I Brown

Dear Public Prosecution Unit - Crown Law,
Thank you for your reply, for which I am grateful. In reviewing the response, I note that the response relates to only Crown prosecutors. However, my request was for the overall number of lawyers classified at those levels, excluding PPS lawyers, not just for Crown prosecutors.
I understand that Crown Law also classifies departmental (and Police) prosecutors as well, in that departmental prosecutors send applications to Crown Law for determination of their classification as a prosecutor. If this is correct, I would be grateful if you could confirm whether my understanding is correct and if it is please provide the overall number of prosecutors according to those classifications, not just those working in Crown solicitor's offices.
Yours sincerely,
I Brown

Dear OIA,
Thank you for your reply. Please note that this is not a new OIA request, but rather I pointed out that I don't think that you have provided all of the information requested in your answer. I don't think that the 20 working days starts again, we are still under the old request.
Yours sincerely,
I Brown

Tēnā koe,
We are currently working on your request regarding classifications of
prosecutors at government agencies, however in the interim I wanted to
clarify why we have treated it as a new request.
Your original request of 26 November 2022 for the number of lawyers
classified as junior, intermediate, senior and principal was understood to
only be about Crown prosecutors as only Crown prosecutors have those
classifications. Additionally your other request of the same date also
sought information related to Crown Solicitors and Crown prosecutors, that
being the Crown Solicitors Terms of Office and Crown Solicitor fee
information. This further indicated the interest was in Crown prosecutors.
Prosecutors at government agencies are separate. While there is a
classification framework that applies to these prosecutors, it is
different to what the Crown prosecutors have. The framework we have for
prosecutors at government agencies sets the classifications as Level 1, 2
and 3. More detail about classifications data of agency prosecutors will
be provided in the full response in due course.
Ngā mihi
